RESOLUTION NO. 2 <br /> SERIES 2001 <br /> <br /> A RESOLUTION APPROVING <br />A FINAL PUD DEVELOPMENT PLAN FOR <br />LOTS 15 THROUGH 18, BLOCK 1, <br /> THE BUSINESS CENTER AT CTC, <br /> <br /> WHEREAS, there has been submitted to the Louisville City Council, a request for <br />approval of a Final PUD Development Plan for three buildings totaling approximately 134,000 <br />square feet on Lots 15 through 18, Block 1, The Business Center at CTC; and <br /> <br /> WHEREAS, all materials related to the Final PUD Development Plan have been <br />reviewed by City Staff and the Planning Commission and found, without conditions, to be in <br />compliance with the Louisville zoning ordinances, subdivision regulations, the Commercial <br />Development Design Standards and Guidelines, related policies and previous approvals; and <br /> <br /> WHEREAS, after a duly noticed public hearing concerning said Final PUD <br />Development Plan, where evidence and testimony were entered into the public record, <br />including the Staff Report dated December 12, 2000, the Planning Commission recommended <br />approval to the City Council, with conditions; and <br /> <br /> WHEREAS, City Council has reviewed the application and finds that said Final PUD <br />Development Plan should be approved, with the following conditions: <br /> <br />1. That a standard covenant agreement holding Lots 15 and 16 as a single parcel is recorded <br /> with Boulder County at or prior to recording of the final PUD plans; <br /> <br />2. That a shared access agreement~easement for Lots 15, 16, and 17 shall be recorded with <br /> the Clerk and Recorder at or prior to recording of the final PUD; <br /> <br />That the additional access and utility easement area on Lot 15, shall be dedicated as a <br />public access and utility easement at or prior to recording of the final PUD, without <br />requirement for compensation from either the City or the benefited property owner, <br />provided that the Owner, it's successors and assigns shall receive 7, 962 square feet of <br />credit toward future public use dedications (as required by Section 16.16. 060 of the LMC) <br />on other parcel(s) selected by Colorado Tech Land Company, LLC, its designees, <br />successors and assigns within the Colorado Technological Center, provided, however in no <br />event shall the credit be applied in a situation where the credit would exceed 50 percent of <br />the total required public use dedication for said parcel, unless approved otherwise by <br />Council; and <br /> <br /> <br />
