ORDINANCE NO. 1578 <br /> SERIES 2010 <br /> AN ORDINANCE AMENDING SECTION 1.24.010 OF THE LOUISVILLE MUNICIPAL <br /> CODE TO REVISE THE RATE FOR CREDIT FOR TIME SERVED FOR ANY <br /> PERSON IMPRISONED FOR THE NONPAYMENT OF A FINE AND AMENDING <br /> SECTION 9.46.040.A OF THE LOUISVILLE MUNICIPAL CODE PERTAINING TO <br /> PRIMA FACIE EVIDENCE FOR SHOPLIFTING <br /> WHEREAS, the City has previously adopted an ordinance codified at Section 1.24.010 <br /> of the Louisville Municipal Code stating that any person imprisoned for nonpayment of a fine <br /> shall be credited for time served at the rate of $25.00 per 24 -hour day, exclusive of board; and <br /> WHEREAS, the City Council desires to amend Section 1.24.010 of the Louisville <br /> Municipal Code in order to increase the rate for any person imprisoned for the nonpayment of a <br /> fine from $25.00 per 24 -hour day to $50.00 per 24 -hour day; and <br /> WHEREAS, the City has previously adopted an ordinance codified at Section <br /> 9.46.040.A of the Louisville Municipal Code stating in part that concealment shall constitute <br /> prima facie evidence with respect to prosecution of the offense of shoplifting; and <br /> WHEREAS, the City Council desires to amend Section 9.46.040.A of the Louisville <br /> Municipal Code so that certain language therein tracks the language of C.R.S. 18 -4 -406; <br /> NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE <br /> CITY OF LOUISVILLE, COLORADO: <br /> Section 1. Section 1.24.010 of the Louisville Municipal Code is hereby amended to <br /> read as follows (words to be deleted are shown in str-ilEeettt; words to be added are underlined): <br /> Sec. 1.24.010 Credit on fine or for time served. <br /> Any person imprisoned for the nonpayment of a fine shall be credited for time served <br /> at the rate of $25.00 $50.00 per 24 -hour day, exclusive of board. <br /> Section 2. Section 9.46.040.A of the Louisville Municipal Code is hereby amended to <br /> read as follows (words to be deleted are shown in strikeout; words to be added are underlined): <br /> Sec. 9.46.040 Shoplifting. <br /> A. It is unlawful for any person to knowingly conceal unpurchased goods, wares or <br /> merchandise of a value of less than $1,000.00 owned or held by and offered or displayed <br /> for sale by any store or other mercantile establishment, with the intent to avoid payment <br /> therefor.
