<br /> AN ORDINANCE APPROVING THE VACATION OF AN EXISTING 16 FOOT
<br /> WATER LINE EASEMENT LOCATED WITHIN LOTS 102, 103, 134, 146 AND 147,
<br /> PARKWOOD SUBDIVISION, AND LOT 5, BLOCK 9 AND LOT 9, BLOCK 6,
<br /> PARKWOOD FILING NO. 2, WITHIN THE CITY OF LOUISVILLE
<br /> WHEREAS, by the Parkwood Subdivision Plat recorded in the Office of the Boulder
<br /> County Clerk and Recorder on April 20, 1973 at Plan File R P -4, F -2, #29 #30, and by the
<br /> Parkwood Filing No. 2 Subdivision. Plat recorded in the Office of the Boulder County Clerk and
<br /> Recorder on December 21, 1976 at Plan File P -5, F -4, #19, there was dedicated to the City of
<br /> Louisville a 16 foot water line easement for the placement of a 16 inch water line over portions of
<br /> Lots 102, 103, 134, 146 and 147 Parkwood Subdivision, and over portions of Lot 5, Block 9 and
<br /> Lot 9, Block 6, Parkwood Filing No.2, in the City of Louisville, County of Boulder, State of
<br /> Colorado; and
<br /> WHEREAS, the purpose of such easement was to provide access for the City of Louisville
<br /> to install and maintain a 16 inch water line for water service to the homes within said subdivisions;
<br /> and
<br /> WHEREAS, application has been made to the City for vacation of the 16 foot water line
<br /> easement; and
<br /> WHEREAS, the City of Louisville Public Works Department has determined that the 16
<br /> foot water line easement is no longer necessary for maintenance access to the Parkwood Subdivision
<br /> and the Parkwood Filing No. 2 Subdivision because the 16 inch water line has been abandoned; and
<br /> WHEREAS, the City Council has determined that the 16 foot water line easement is no
<br /> longer necessary for maintenance access because the 16 inch water line has been abandoned and
<br /> filled, and has further determined that the easement for which vacation is requested is no longer
<br /> used, held or needed for any utility, park, public or governmental purpose; and
<br /> WHEREAS, the City Council desires to approve the application and vacate any interest the
<br /> City may have in the 16 foot water line easement for which vacation is requested;
<br /> NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
<br /> OF LOUISVILLE, COLORADO:
<br /> Section 1. The City hereby vacates the City's interests in that certain 16 foot water line
<br /> easement dedicated to the City by the Parkwood Subdivision Plat, recorded in the Office of the
<br /> Boulder County Clerk and Recorder on April 20, 1973 at Plan File R P -4, F -2, #29 #30, and by the
<br /> Parkwood Filing No. 2 Subdivision Plat, recorded in the Office of the Boulder County Clerk and
<br /> Recorder on December 21, 1976 at Plan File P -5, F -4, #19, which vacated 16 foot water line
<br /> easement is located within portions of Lots 102, 103, 134, 146 and 147 Parkwood Subdivision,
<br /> and Lot 5, Block 9 and Lot 9, Block 6, Parkwood Filing No. 2, in the City of Louisville, County of
<br /> Ordinance 1581, Series 2010
