I reviewed <br />the documents you provided, and various documents Mr. Stewart sent <br />to me, and have the following comments. <br />I understand that the City Planning Director has determined that, <br />because Mr. Stewart demolished the existing non -conforming <br />structure, L.M.C. Section 17.36.060.A applies and any future <br />structure on the property must conform to the provisions of the <br />Code or a variance from the Board of Adjustment must be obtained. <br />It is my view that established City procedures should be used to <br />resolve any concern that may exist with respect to the Planning <br />Director's decision. <br />If Mr. Stewart disagrees with the determination of the Planning <br />Director, his remedy is to appeal the decision to the Board of <br />Adjustment pursuant to L.M.C. Section 17.48.090. The appeal must <br />be taken within thirty days of the decision made which is being <br />appealed. The proce,,s for the appeal is set forth in that Section. <br />I recommend that the decision of the Planning Director be put in <br />writing, if it is not already in writing, and dated so that the <br />decision and the time within which Mr. Stewart may file an appeal <br />will be clearly understood by him and all others affected by the <br />decision. <br />Alternatively, Mr. Stewart may file an application for a variance <br />with the Board of Adjustment to permit construction of the <br />structure to proceed. <br />Since an appeal and a variance are two different actions, <br />presumably Mr. Stewart could file both if he so chose. <br />cc: Annette Brand, City Administrator <br />113093/833(dim]c:lvilie \grentst.MOO <br />
