RESOLUTION NO. 11 SERIES 2010 A RESOLUTION APPROVING A PLANNED COMMUNITY ZONE DISRICT ZONING AGREEMENT FOR THE 390.013 -ACRE CONOCOPHILLIPS CAMPUS WHEREAS, there has been submitted to the Louisville City Council by ConocoPhillips Company a request to zone a 390.013 -acre parcel owned by ConocoPhillips Company, to be known as the ConocoPhillips Campus, as Planned Community Zone District Commercial (PCZD -C); and WHEREAS, the Planned Community Zone District regulations of the City require that such a zone district be accompanied by an agreement; and WHEREAS, there has been proposed a PCZD zoning agreement between the City of Louisville and ConocoPhillips Company setting forth mutual understandings of the parties regarding certain matters related to the zoning and development of the property legally described in Exhibit A to such agreement; and WHEREAS, the City Council by this Resolution desires to approve the proposed PCZD zoning agreement and authorize its execution. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LOUISVILLE, COLORADO: Section 1. The proposed Planned Community Zone District Zoning Agreement ConocoPhillips Campus General Development Plan) ("Agreement") between the City of Louisville and ConocoPhillips Company is hereby approved in essentially the same form as the copy of such Agreement accompanying this Resolution. Section 2. The Mayor is authorized to execute the Agreement on the behalf of the City, except that the Mayor is, hereby granted the authority to negotiate and approve such revisions to said Agreement as the Mayor and City Manager determine are necessary or desirable for the protection of the City, so long as the essential terms and conditions of the Agreement are not altered.
