RESOLUTION NO. 2 <br /> SERIES 2011 <br /> A RESOLUTION APPROVING A FINAL PLANNED UNIT DEVELOPMENT (PUD) <br /> AMENDMENT AND A SPECIAL REVIEW USE (SRU) REQUEST TO INCORPORATE <br /> A SECOND STORY TO THE EXISTING BUILDING AT 817 MAIN STREET (ALLEY <br /> CAT BAR GRILL) WHICH WILL CONSIST OF 50% ENCLOSED SPACE TO <br /> HOUSE A GAME ROOM, OFFIICES, BATHROOMS AND STAIRWAYS, AS WELL AS <br /> 50% OF OPEN AIR PATIO SEATING FOR OUTSIDE DINING, IN A BUILDING <br /> LOCATED IN THE COMMERCIAL- COMMUNITY (CC) ZONE DISTRICT. <br /> WHEREAS, there has been submitted to the Louisville City Council an <br /> application for a final planned unit development (PUD) amendment and a special review <br /> use (SRU) request to incorporate a second story to the existing building at 817 Main <br /> Street (Alley Cat Bar Grill) which will consist of 50% enclosed space to house a game <br /> room, offices, bathrooms and stairways, as well as 50% of open air patio seating for <br /> outside dining; and <br /> WHEREAS, the City Staff has reviewed the information submitted and found it, <br /> with conditions, to comply with Louisville zoning regulations, required general and <br /> specific design standards, and the City's special review use criteria and other applicable <br /> sections of the Louisville Municipal Code; and <br /> WHEREAS, after a duly noticed public hearing on December 9, 2010, where <br /> evidence and testimony were entered into the record, including the findings in the <br /> Louisville Planning Commission Staff Report dated December 9, 2010, the Planning <br /> Commission recommended approval of said special review use with conditions: <br /> 1. Hours of operation for the outdoor patio shall be limited to 12 am. <br /> 2. Patio lighting shall be limited to low wattage down -cast lighting only. <br /> 3. There will be no dancing or live music permitted in the open deck area. <br /> 4. The business shall provide sidewalk dining in the appropriate seasons to <br /> maintain street level pedestrian activities; and <br /> WHEREAS, City Council has reviewed the application, including the <br /> recommendation of the Planning Commission, and finds that it complies with Chapter <br /> 17.40.100 of the Louisville Municipal Code; <br /> NOW THEREFORE, BE IT RESOLVED that the City Council of the City of <br /> Louisville, Colorado does hereby approve a final planned unit development (PUD) <br /> amendment and a special review use (SRU) request to incorporate a second story to <br /> the existing building at 817 Main Street (Alley Cat Bar Grill) which will consist of 50% <br /> enclosed space to house a game room, offices, bathrooms and stairways, as well as <br /> 50% of open air patio seating for outside dining, with the following conditions: <br /> Resolution No. 2, Series 2011 <br /> Page 1of <br />
