<br /> ORDINANCE NO. 1506 <br /> SERIES 2006 <br />AN ORDINANCE REPEALING AND REENACTING CHAPTER 3.18 OF THE LOUISVILLE <br />MUNICIPAL CODE REGARDING DEVELOPMENT IMPACT FEES FOR MUNICIPAL <br />CAPITAL FACILITIES, TRANSPORTATION CAPITAL FACILITIES, LIBRARY CAPITAL <br />FACILITIES, PARKS AND TRAILS CAPITAL FACILITIES AND RECREATION CAPITAL <br />FACILITIES. <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF <br />LOUISVILLE, COLORADO: <br />Section 1. Legislative Findings: The City Council of the City of Louisville, Colorado fmds <br />that: <br />1. New Development Placing Demand on City's Municipal Capital Facilities, Library <br /> Capital Facilities, Transportation Capital Facilities, Parks and Trails Capital <br /> Improvements, and Recreation Capital Facilities. <br /> New development in the City is placing and is projected to place an increased demand upon <br /> the City's Municipal Capital Facilities, Library Capital Facilities, Transportation Capital <br /> Facilities, Parks and Trails Capital Improvements, and Recreation Capital Facilities. <br />2. Need for Expansion of these Capital Facilities to Protect Health, Safety and Welfare. <br /> The protection of the health, safety, and general welfare of the citizens of the City requires <br /> that these Capital Facilities be expanded to accommodate and serve this continuing growth <br /> within the City from new development. <br />3. Revenue Shortfall. <br /> The tax and other revenues generated from new development does not generate sufficient <br /> funds to provide the necessary City Municipal Capital Facilities, Library Capital Facilities, <br /> Transportation Capital Facilities, Parks and Trails Capital Improvements, or Recreation <br /> Capital Facilities to accommodate and serve new development. <br />4. Impact Fees Preferred Method. <br /> The adoption of an equitable Impact Fee system consistent with the requirements of <br /> applicable law is one of the preferred methods of the City for regulating land development <br /> to ensure new development pays a proportionate and fair share of the costs of the needed <br /> Capital Facilities, allowing the City to make the necessary Capital Facility expenditures to <br /> serve new development. <br />5. Impact Fee Study to Support Impact Fees. <br /> In order to implement an equitable Impact Fee system, the City prepared an impact fee <br /> study entitled City of Louisville, Colorado Impad Fees dated November 9, 2006 (hereinafter <br /> "Impad Fee Stu4J"). Based on reasonable methodologies and analyses for determining the <br /> impacts of new development on the City's Municipal Capital Facilities, Library Capital <br /> Facilities, Transportation Capital Facilities, Parks and Trails Capital Facilities, and Recreation <br /> Capital Facilities, the Impad Fee Stu4J quantifies the reasonable impacts of new development <br /> on these Capital Facilities, and establishes an Impact Fee no greater than is necessary to <br /> defray the projected impacts on these Capital Facilities directly related to proposed new <br /> development. <br /> 1 <br />
