<br />ORDINANCE NO. 1269 <br />SERIES 1997 <br /> <br />AN ORDINANCE AMENDING ORDINANCE NO. 501, SERIES 1976, TO ELIMINATE <br />THE GEOLOGIC HAZARD AREA DESIGNATION FOR OUTLOT A OF LOT 1, BLOCK <br />8, COLORADO TECHNOLOGICAL CENTER FILING NO.1. <br /> <br />WHEREAS, pursuant to C.R.S. ~~24-65.1-101 et sea. ("House Bill <br />1041"), the City is authorized to designate matters of state <br />interest, including geologic hazard areas; and <br /> <br />WHEREAS, pursuant to House Bill 1041, the City by Ordinance <br />No. 501, Series 1976, designated the boundaries of certain geologic <br />hazard areas within property in the City and generally known as the <br />Colorado Technological Center ("CTC"); and <br /> <br />WHEREAS, pursuant to House Bill 1041 and Louisville Municipal <br />Code Chapters 17.32 and 17.44, the City has authority to amend the <br />designated boundaries of a geologic hazard area; and <br /> <br />WHEREAS, the owner of Lot 1, Block 8, CTC Filing No. 1 has <br />requested that the City amend Ordinance No SOl, Series 1976, to <br />eliminate the geologic hazard area designation for Outlot A of Lot <br />1, Block 8, CTC Filing No.1 ("Outlot A"); and <br /> <br />WHEREAS, the Louisville Planning Commission has held a public <br />hearing on the request and has forwarded a recommendation to the <br />City Council; and <br /> <br />WHEREAS, the City Council has duly considered the Commission's <br />recommendation and has held a public hearing on the request; and <br /> <br />WHEREAS, at the hearing[ there was presented evidence in <br />support the owner's request, including evidence that Ordinance No. <br />SOl, Series 1976, erroneously designated Outlot A as a geologic <br />hazard area; and <br /> <br />WHEREAS, the City Council finds that the granting of the <br />request to eliminate the geologic hazard area designation for <br />Outlot A is not contrary to the public health, safety and welfare, <br />and otherwise meets the criteria of House Bill 1041 and the <br />Louisville Municipal Code. <br /> <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br /> <br />Section 1. Ordinance No. SOl, Series 1976, is hereby <br />amended to eliminate the geologic hazard area designation for <br />Outlot A of Lot 1, Block 8, CTC Filing No.1, and the geologic <br />hazard area maps maintained by the City shall be amended <br /> <br />1 <br />
