<br />ORDINANCE NO. 1160 <br />SERIES 1994 <br /> <br />AN ORDINANCE AMENDING SECTION 8.08.020.A, AS AMENDED BY <br />ORDINANCE NO. 1149, SERIES 1994, AND SECTION 8.08.030 OF <br />THE LOUISVILLE MUNICIPAL CODE CONCERNING WEED CONTROL AND <br />DECLARING AN EMERGENCY. <br /> <br />WHEREAS, C.R.S S31-15-401 authorizes the City to implement <br />regulations for the control of weeds; and <br /> <br />WHEREAS, the City has undertaken to regulate and control the <br />growth of weeds within the City and adopted regulations generally <br />codified in Chapter 8.08 of the Louisville Municipal Code; and <br /> <br />WHEREAS, the City Council has determined that effective <br />control of the growth of noxious weeds on residential property <br />requires the revision of said regulations, and that an emergency <br />exists because it is the peak growing season for such noxious <br />weeds. <br /> <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br /> <br />Section 1. Section 8.08.020.A. of the Louisville Municipal <br />Code, as amended by Section 2 of Ordinance No. 1149, Series 1994, <br />is hereby amended to read as follows (words to be added are <br />capitalized) : <br /> <br />8.08.020 <br /> <br />Control of weeds required. <br /> <br />A. It is unlawful for the owner of any property, <br />except property zoned agricultural OR PROPERTY <br />DEVELOPED FOR RESIDENTIAL USE, to permit weeds to <br />grow to a height in excess of twelve inches. IT IS <br />UNLAWFUL FOR THE OWNER OF PROPERTY DEVELOPED FOR <br />RESIDENTIAL USE TO PERMIT WEEDS TO GROW TO A HEIGHT <br />IN EXCESS OF SIX INCHES. It shall be the duty of <br />the owner, agent, or occupant of any property to <br />control the growth of weeds on said property as <br />required by this section, on alleys abutting the <br />property to the middle of the alley, and on <br />sidewalk areas abutting the property, including all <br />parking areas. <br /> <br />1 <br />
