RESOLUTION NO. 10 <br /> SERIES 2013 <br /> A RESOLUTION APPROVING THE CONSENT TO PAY FOR RIGHTS-OF-WAY AS <br /> PROVIDED BY SOUTHERN WATER SUPPLY PROJECT ALLOTMENT <br /> AGREEMENTS <br /> WHEREAS, the City of Louisville ("City") and the Northern Colorado Water Conservancy <br /> District acting by and through the Southern Water Supply Project Water Activity Enterprise ("SWSP <br /> Enterprise")previously entered into an Allotment Contract for the City's participation in the Southern <br /> Water Supply Project("SWSP"); and <br /> WHEREAS, the SWSP Allotment Contract provides for the utilization of the rights-of-way <br /> for additional pipelines; and <br /> WHEREAS, a Consent To Agreement to Pay for Rights-of-Way has been proposed for the <br /> utilization of SWSP rights-of-ways for the SWSP II project and for reimbursement to the City and <br /> other SWSP participants for the costs of acquisition of SWSP rights-of-way, and the City Council <br /> desires to approve such consent agreement and authorize its execution. <br /> NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br /> LOUISVILLE,COLORADO: <br /> 1. The proposed Consent To Agreement to Pay for Rights-of-Way as Provided by <br /> Southern Water Supply Project Allotment Contracts ("Consent Agreement") between the City of <br /> Louisville and the SWSP Enterprise, for the utilization of rights-of-way by SWSP II, is hereby <br /> approved in essentially the same form as the copy of such Consent Agreement accompanying this <br /> Resolution. <br /> 2. The Mayor is authorized to execute such Consent Agreement on behalf of the City, <br /> except that the Mayor is hereby granted the authority to negotiate and approve such revisions to said <br /> Consent Agreement as the Mayor determines are necessary or desirable for the protection of the City, <br /> so long as the essential terms and conditions of the Consent Agreement are not altered. <br /> 3.
