CITY OF LOUISVILLE <br />Resolution No. 11 <br />Series, 1976 <br />A resolution concerning the general application of H.B. 1041 (1974) <br />regarding "Flood Hazard Areas" as an area of state interest as it applies <br />to the City of Louisville land use and development controls and the <br />designation of the Colorado Technological Center as a flood hazard area <br />of state interest. <br />WHEREAS, the Planning Commission of the City of Louisville, by <br />resolution, identified certain flood plain areas as being potential <br />flood hazard areas of state interest and such identification included a <br />portion of the Colorado Technological Center site, and <br />WHEREAS, the City of Louisville desires at this time to establish <br />the general application of flood hazard area of state interest to its <br />land use and development controls and to the Colorado Technological <br />Center, and <br />WHEREAS, subsequent to the effective date of the annexation of the <br />Colorado Technological Center the City Council ordered a public hearing <br />to be held to consider said designation and notice bf said public <br />hearing was published and sent to the Land Use Commission as required <br />in § 106-7-404 H.B. 1041 (1974), and <br />WHEREAS, said public hearing was held on May 4, 1976 and which <br />hearing was continued to and closed on June 1, 1976, and <br />WHEREAS, the City of Louisville presently regulates development <br />of flood hazard areas through Ordinance No. 456 and No. 465 and designation <br />of said areas would result in unnecessary and counter-productive duplication <br />of coq~rols, and <br />WHEREAS, ~ 2-1-104 of the Colorado Land Use Commission "Guidelines <br />for Identification and Designation," adopted September 19, 1975 provide <br />for achieving the intent of H.B. 1041 (1974) through land use control <br />procedures authorized by statute other than H.B. 1041 (1974), and <br />
