RESOLUTION NO 16 <br />SERIES 2015 <br />A RESOLUTION APPROVING A FINAL PLAT AND SPECIAL REVIEW USE (SRU) <br />TO PERMIT THE CONSTRUCTION OF NEW AT GRADE SAND DRYING BEDS TO <br />HANDLE THE HOWARD BERRY WATER TREATMENT PLANT RESIDUALS AT <br />7000 MARSHALL ROAD. <br />WHEREAS, there has been submitted to the Louisville City Council an <br />application for approval of a Final Plat Special Review Use (SRU) to permit the <br />construction of new at grade sand drying beds to handle the Howard Berry Water <br />Treatment Plant residuals at 7000 Marshall Road; and <br />WHEREAS, the City Staff has reviewed the information submitted and found into <br />comply with Chapter 16, Section 17.40, and Section 17.12.040 and the special review <br />use criteria as set forth in Section 1740.100 of the Louisville Municipal Code, and other <br />applicable requirements; and <br />WHEREAS, after a duly noticed public hearing on March 17, 2015, where <br />evidence and testimony were entered into the record, including the findings in the <br />Louisville Planning Commission Staff Report dated March 17, 2015, the Planning <br />Commission recommended approval of said Howard Berry WWTP Final Plat, and SRU, <br />located at 7000 Marshall Road, to the City Council; and <br />WHEREAS, City Council has reviewed the application, including the <br />recommendation of the Planning Commission, and finds that it complies with Chapter <br />16, Section 17.40, and Section 17.12.040 and the special review use Criteria as set forth <br />in Section 17.40.100 of the Louisville Municipal Code, and other applicable <br />requirements. <br />NOW THEREFORE, BE IT RESOLVED that the City Council of the City of <br />Louisville, Colorado does hereby approve a Final Plat and Special Review Use (SRU) to <br />permit the construction of new at grade sand drying beds to handle the Howard Berry <br />Water Treatment Plant residuals at 7000 Marshall Road, subject to the condition that <br />the Plat dedication statement be revised to remove the access easement dedication as <br />the trail corridor will be established at a later date. <br />PASSED AND ADOPTED this 7th day of Apri <br />2015. <br />Bv: <br />ancy Varr• , City Clerk <br />City of Louisville, Colorado <br />Robert P.
