RESOLUTION NO. 14 <br />SERIES 2015 <br />A RESOLUTION APPROVING A FINAL SUBDIVISION PLAT, SPECIAL REVIEW <br />USE (SRU) AND A FINAL PLANNED UNIT DEVELOPMENT (PUD) TO DEVELOP <br />PHASE 2 OF A REDEVELOPMENT PROJECT WITHIN THE CORE PROJECT AREA <br />OF THE HWY 42 FRAMEWORK PLAN. THE PROJECT INCLUDES A DIVERSITY <br />OF HOUSING PRODUCTS, CIVIC SPACES, URBAN PLAZAS, STREETSCAPES <br />AND COMMERCIAL OPPORTUNITIES <br />WHEREAS, there has been submitted to the Louisville City Council an <br />application for approval of a final subdivision plat, special review use (SRU) and a final <br />planned unit development (PUD) to develop phase 2 of a redevelopment project within <br />the core project area of the HVVY 42 framework plan. The project includes a diversity of <br />housing products, civic spaces, urban plazas, streetscapes and commercial <br />opportunities, formally known as DELO; and <br />WHEREAS, the subject property is in the Highway 42 Revitalization Area; and <br />WHEREAS, the ground floor residential along Cannon Street requires a special <br />review use permit and staff has found the request with conditions meets the five criteria <br />established in Section 17.40.100 in the LMC; and <br />WHEREAS, the City Staff has reviewed the information submitted and found it to <br />comply with the LMC Sec. 16.12.030, Sec. 17.14.090, Sec. 17.28.170; and Sec. <br />17.40.100; and <br />WHEREAS, after a duly noticed public hearing on March 17, 2015, where <br />evidence and testimony were entered into the record, including the findings in the <br />Louisville Planning Commission Staff Report dated March 17, 2015, the City of <br />Louisville Planning Commission approved a resolution to forward a recommendation of <br />approval, with the following conditions, to the City Council; <br />1. The applicant shall continue to work with the City on the specifics of the <br />maintenance of open space and roadways. Final details will be included in the <br />submittal packet prior to City Council. <br />2. If an offsite solution cannot be found, staff requires the detention basin and public <br />gathering space, as depicted in DELO Phase 1 and 1A, be located in Outlot B, <br />Outlot C and within the E. Lafayette Street right of way. The basin should be <br />designed to provide stairs, stepping down from Cannon Street through the <br />proposed retaining walls, to make this space more publically interactive. The <br />stairs should be a minimum width of 50 feet along Canon Street, or a mutually <br />support design alternative that is open and accessible. <br />3. Should a regional offsite detention basin be created to detain the drainage of the <br />Highway 42 development (including DELO Phase 1/1A and Phase 2), staff <br />requires the applicant reinstate the plans for Nawatny Greenway as depicted in <br />DELO Phase 2 PUD. <br />Resolution No. 14 , Series 2015 <br />Page 1 of 3 <br />
