RESOLUTION NO. 100 <br />SERIES 2020 <br />A RESOLUTION APPROVING A PLANNED UNIT DEVELOPMENT TO ALLOW <br />CONSTRUCTION OF AN ADDITION TO THE EXISTING STRUCTURE AND <br />ASSOCIATED SITE IMPROVEMENTS AND A SPECIAL REVIEW USE TO ALLOW <br />USE GROUP #35, OUTDOOR EATING AND DRINKING ESTABLISHMENTS FOR <br />MOXIE BREAD COMPANY AT 641 MAIN STREET <br />WHEREAS, Moxie Bread Co. has submitted an application for a Planned Unit <br />Development to allow construction of an addition to the existing structure and associated <br />site improvements and a special review use to allow Use Group #35, Outdoor Eating And <br />Drinking Establishments for Moxie Bread Company at 641 Main Street; and <br />WHEREAS, after a duly noticed public hearing on November 12, 2020, where <br />evidence and testimony were entered into the record, including the findings in the <br />Louisville Planning Commission staff report dated November 12, 2020, the Planning <br />Commission recommended approval the Special Review Use and Planned Unit <br />Development with one condition; and <br />WHEREAS, City staff has reviewed the information submitted and found that the <br />application complies with the Louisville zoning regulations and other applicable sections <br />of the Louisville Municipal Code; and <br />WHEREAS, the City Council has considered the application at a duly noticed <br />public hearing on December 15, 2020, where evidence and testimony were entered into <br />the record, including the findings in the Louisville City Council staff report dated December <br />15, 2020. <br />NOW THEREFORE, BE IT RESOLVED that the City Council of the City of <br />Louisville, Colorado does hereby approve a Planned Unit Development to allow <br />construction of an addition to the existing structure and associated site improvements <br />and a special review use to allow Use Group #35, Outdoor Eating And Drinking <br />Establishments for Moxie Bread Company at 641 Main Street, with the following <br />conditions: <br />1. Prior to issuance of a building permit, the applicant shall receive approval of <br />the final utility design from public works. <br />2. Prior to recordation of the PUD and SRU, the applicant shall receive approval <br />of a license agreement with the City to accommodate the encroachments in <br />right-of-way. <br />Resolution No. 100, Series 2020 <br />Page 1 of 2 <br />
