ORDINANCE NO. 1314 <br />SERIES 1999 <br /> <br />AN ORDINANCE AMENDING TITLE 3 OF THE LOUISVILLE MUNICIPAL CODE BY <br />THE ADDITION OF A NEW CHAPTER 3.16, ESTABLISHING A COMMUNITY <br />INVESTMENT FEE. <br /> <br /> WHEREAS, public facilities, including but not limited to, the city hall, library, parks, <br />police station, police communication center, recreation center and senior center, serve general <br />citywide needs and not just the needs of specific neighborhoods in the City; and <br /> <br /> WHEREAS, the City must expand its public facilities if it is to accommodate new <br />development without decreasing current standards for public services; and <br /> <br /> WHEREAS, additional resources are needed in order to pay for such expansion, and there <br />is a demonstrated need to provide these additional capital improvements to serve the City's <br />population; and <br /> <br /> WHEREAS, establishing a community investment fee on new development within the City <br />will assist in defraying the cost of providing or expanding public facilities to meet the demand new <br />development creates in excess of current levels; and <br /> <br /> WHEREAS, the imposition of a community investment fee is the preferable method of <br />ensuring new development bears an appropriate share of the costs of capital improvements <br />necessary to accommodate new development; and <br /> <br /> WHEREAS, the development subject to the community investment fee established herein <br />will necessitate use of public facilities in excess of current levels of service; and <br /> <br /> WHEREAS, the community investment fee established herein is reasonably designed to <br />defray in part the overall costs of the public facilities for which the fee is imposed, and is <br />reasonably related to the needs created or contributed to by new development subject to the fee; and <br /> <br /> WHEREAS, the community investment fee established herein is dedicated to the purpose <br />of defraying in part the costs of public facilities, and related capital improvements, and not for <br />general City purposes. <br /> <br /> NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br /> <br /> Section 1. Title 3 of the Louisville Municipal Code is hereby amended by the addition <br />of new Chapter 3.16, to read as follows: <br /> <br /> <br />
