ORDINANCE NO. 1314 SERIES 1999 AN ORDINANCE AMENDING TITLE 3 OF THE LOUISVILLE MUNICIPAL CODE BY THE ADDITION OF A NEW CHAPTER 3.16, ESTABLISHING A COMMUNITY INVESTMENT FEE. WHEREAS, public facilities, including but not limited to, the city hall, library, parks, police station, police communication center, recreation center and senior center, serve general citywide needs and not just the needs of specific neighborhoods in the City; and WHEREAS, the City must expand its public facilities if it is to accommodate new development without decreasing current standards for public services; and WHEREAS, additional resources are needed in order to pay for such expansion, and there is a demonstrated need to provide these additional capital improvements to serve the City's population; and WHEREAS, establishing a community investment fee on new development within the City will assist in defraying the cost of providing or expanding public facilities to meet the demand new development creates in excess of current levels; and WHEREAS, the imposition of a community investment fee is the preferable method of ensuring new development bears an appropriate share of the costs of capital improvements necessary to accommodate new development; and WHEREAS, the development subject to the community investment fee established herein will necessitate use of public facilities in excess of current levels of service; and WHEREAS, the community investment fee established herein is reasonably designed to defray in part the overall costs of the public facilities for which the fee is imposed, and is reasonably related to the needs created or contributed to by new development subject to the fee; and WHEREAS, the community investment fee established herein is dedicated to the purpose of defraying in part the costs of public facilities, and related capital improvements, and not for general City purposes. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LOUISVILLE, COLORADO: Section 1. Title 3 of the Louisville Municipal Code is hereby amended by the addition of new Chapter 3.16, to read as follows:
