RESOLUTION NO.19 <br />SERIES 2022 <br />A RESOLUTION APPROVING AN INTERGOVERNMENTAL AGREEMENT FOR <br />THE PROVISION OF ASSISTANCE FOR DEBRIS REMOVAL RESULTING FROM <br />THE COLORADO WILDFIRES AND STRAIGHT-LINE WINDS DISASTER <br />(DR-4653-CO) <br />WHEREAS, C.R.S. § 24-33.5-707 authorizes local and interjurisdictional emergency <br />management agencies to establish emergency management plans for its areas that include provision <br />for the response and recovery from emergencies and disasters; and <br />WHEREAS, the Boulder County Office of Emergency Management adopted the Emergency <br />Operations Plan for Boulder County, and this plan authorizes Boulder County to coordinate for and <br />remove debris following a disaster; and <br />WHEREAS, C.R.S § 24-33.5-713 further encourages political subdivisions to make suitable <br />arrangements for furnishing mutual aid in coping with disasters; and <br />WHEREAS, on March 1, 2022, FEMA granted Boulder County's request for additional <br />public assistance funding to expedite economic recovery in the affected communities, including <br />private property debris removal ("PPDR"); and <br />WHEREAS, on February 10, 2022, Boulder County awarded the PPDR contract to DRC <br />Emergency Services, LLC ("DRC"), and DRC's contract will include PPDR in the City, the Town of <br />Superior and unincorporated Boulder County; and <br />WHEREAS, the City, the Town of Superior, and Boulder County have negotiated an <br />Intergovernmental Agreement for the Provision of Assistance for Debris Removal Resulting from the <br />Colorado Wildfires and Straight -Line Winds Disaster (DR-4653-CO) (the "IGA"), which addresses <br />how the PPDR work will be conducted in each jurisdiction and invoicing and payment for such work; <br />and <br />WHEREAS, the IGA provides the City will pay to Boulder County an amount equal to 5% <br />of the cost PPDR work completed by DRC within the City that is anticipated to be reimbursed by <br />FEMA (the "local cost share"), plus the entire cost of work performed by DRC that is not eligible for <br />FEMA reimbursement but which the City has requested be performed by DRC, subject to an amount <br />not to be exceeded that is specified in Section 7; and <br />WHEREAS, the City Council has reviewed the IGA, finds its terms acceptable, and desires <br />by this resolution to approve the same. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br />Resolution No. 19, Series 2022 <br />Page 1 of 2 <br />
