<br />CITY COUNCIL MEETING <br /> <br />January 16, 1973 <br /> <br />Regular meeting called to order by Mayor Lawrence Caranci. <br /> <br />ROLL CALL: Present - Deborski, King, Jensen, Scholl, Domenico. <br />Absent - Donovan <br /> <br />ACCEPTANCE OF MINUTES: Approved as presented. <br /> <br />CORRESPONDENCE: None <br /> <br />JENSEN: Read letter from Denver Regional Council of Governments in regards to the <br />potentials of new hi-ways in Colorado. Implement the transit plan. <br />MR. WURL: Read letter of increase of sewer plant grant addressed to Mr. Perrells <br />for sewerage work Part B - Estimate increased to $413,00 from $361,400 on <br />which the original grant offer was based. Current grant offer increased <br />by $190,490 or from $119,260 to $309,750 or 75% of the eligible cost. This <br />offer is subject to the same assurances and conditions in the original grant <br />offer, accepted by Louisville Sanitation District, July 1972. <br /> <br />URBAN RENEWAL: Minutes approved as presented. <br /> <br />FILTER PLANT: Letter from Duane Johnson outlining what is left to be done by CAP <br />Construction Co. at the filter plant. <br />MAYOR CARANCI: Asked Ajax repr+::sentatives when they would finish the water line, <br />They stated they have the pipe at the site and have brought in equipment and <br />started to get the two connections on the church line - one north end and <br />South Boulder Road, one by Steve Harney's place. Brought the crew in and <br />understood the church did not give an easement to cross their property. <br />Impossible to do anything until an easement is obtained. All lines are <br />flushed except the church. <br />MAYOR CARANCI: <br />How about the broken pipe? <br />AJAX: We will put in a kick block when we pour cement. <br />CARANCI: In o the r words you' ria already to tie in with the exception of the church. <br />MR. WURL: The easements are only surface - the last correspondence we had with the <br />church was on October 19, 1971. Received a letter, among other things, they <br />were making a demand for $2,692.00 for ~ut of the pocket expense due to de- <br />lay in consltruction of the church. Mr. Wurl met with Duane Johnson & Ken <br />Bruns - tried to come up 'v;ri th an easement but was unable to find anything <br />but the surface easement. <br />CARANCI: That easement on their land is only laO', Along the south side js a <br />surface easement for ingress and egress from the park. The 16" line is to <br />the south. <br />MR. WURL: It appears that we may not have any trouble on the north if they have <br />actually deeded that right of way for street purposes. <br />They don't want to discuss this matter until we take care of the $2,692.00. <br />KING: Didn't the previous Council agree that we had in fact delayed their building <br />the time we took to decide what we were going to do in regards to this water <br />line, all agreed to a certain amount of liability. <br />MORRIS: I don't believe we ever agreed to a fixed liability. No question that we <br />did delay the construction. As I recall it was decided rather than condemn <br />
