<br />RESOLUTION NO. 14 <br />SERIES 2004 <br /> <br />A RESOLUTION APPROVING <br />AN AMENDMENT TO THE COLONY SQUARE FINAL PUD TO ALLOW FOR THE <br />CONSTRUCTION OF A STAIRWAY STRUCTURE, ELEVATOR, BRIDGE ABUTMENT, <br />PLAZA AREAS AND SIDEWALKS ASSOCIATED WITH A PEDESTRIAN BRIDGE AND <br />RTD PARK-n-RIDE LOT AT US 36 AND McCASLIN BOULEVARD <br /> <br />WHEREAS, there has been submitted to the Louisville City Council an application to <br />amend the Colony Square Final PUD to allow for the construction of a stairway structure, elevator, <br />bridge abutment and plaza areas sidewalks associated with a pedestrian bridge and RTD park-n- <br />Ride at US 36 and McCaslin Boulevard; <br /> <br />WHEREAS, the City Staff and the City of Louisville Planning Commission has reviewed <br />the information submitted and found it to comply with Louisville Municipal Code - Chapter 17.28 <br />as well as the pertinent Commercial Development Design Standards and Guidelines; and, <br /> <br />WHEREAS, after a duly noticed public hearing on 17 February 2004, where evidence and <br />testimony were entered into the record, including the findings in the Louisville Planning <br />Commission Staff Report date 10 February 2004, the City of Louisville City Council finds that the <br />Colony Square Final PUD should be approved and amended as presented with the following <br />conditions: <br /> <br />1) An easement agreement for the City outlot shall be secured by RTD from the City of Louisville <br />prior to the issuance of any construction pemlits that would allow for the construction of a stairway <br />structure, elevator, bridge abutment and plaza areas sidewalks associated with a pedestrian bridge <br />and RTD bus stop at US 36 and McCaslin Boulevard; <br /> <br />2) An easement agreement for the City outlot shall be secured by RTD with the City of Louisville <br />prior to the issuance of any construction pemlits that would allow for the construction of any RTD <br />site location sign associated with the pedestrian bridge and RTD bus stop at US 36 and McCaslin <br />Boulevard; <br /> <br />3) The shared parking agreement between the Colorado Cinemas / Colony Square PUD and The <br />Village Shops at Colony Square that would permit the sharing of parking spaces between the two <br />parties for the RTD use reviewed herein, shall be secured, signed, and reviewed by Planning Staff <br />prior to the commencement of construction. <br /> <br />NOW THEREFORE, BE IT RESOLVED that the City Council of Louisville, Colorado <br />does hereby approve an amendment request to the Colony Square Final PUD to allow for the <br />construction of a stairway structure, elevator, bridge abutment and plaza areas sidewalks associated <br />with a pedestrian bridge and RTD park-n-Ride at US 36 and McCaslin Boulevard. <br />
