01/09/2002 01:44P <br /> Boulder County Clerk, CO ORD R 10.00 D 0.00 <br /> <br />ORDINANCE NO. 1373 <br />SERIES 2001 <br /> <br />AN ORDINANCE APPROVING THE <br />EASEMENT WITHIN THE ALVENUS <br />CITY OF LOUISVILLE. <br /> <br />VACATION OF AN ACCESS <br />PARK SUBDIVISION IN THE <br /> <br /> WHEREAS, by the final plat of Alvenus Park Subdivision, recorded January 23, 1995, as <br />Plan File P-33, F-2, #3, and Film No. 2032, Reception No. 1493909, Boulder County Records, <br />there was dedicated to the City a 50-foot by 190-foot joint access easement lying within Lots 2 and <br />3 of said Alvenus Park Subdivision (the "Joint Access Easement"); and <br /> <br /> WHEREAS, proper application has been made to the City for vacation of such Joint <br />Access Easement; and <br /> <br /> WHEREAS, the City Council has determined that the Joint Access Easement for which <br />vacation has been requested is not and has not been used or required as a roadway or thoroughfare <br />for the public; and <br /> <br /> WHEREAS, the City Council has determined that the Joint Access Easement for which <br />vacation is requested is not and will not be needed for any public purpose; and <br /> <br /> WHEREAS, the City Council has determined that the Joint Access Easement for which <br />vacation is requested is not being used or held for park purposes or for any other governmental <br />purposes; and <br /> <br /> WHEREAS, the City Council desires to approve the application and vacate the City's <br />interests in the Joint Access Easement described herein for which vacation is requested. <br /> <br /> NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br /> <br /> ,Rectltm l. The City hereby approves the vacation of that certain 50-foot bv 190-foot <br />joint access easement lying within Lots 2 and 3 of Alvenus Park Subdivision, City of Louisville, <br />Boulder County, Colorado, which is particularly described in the Vacation of Easement attached <br />hereto and incorporated herein by reference. The Mayor and City Clerk are hereby authorized to <br />execute the Vacation of Easement on behalf of the City. <br /> <br /> ~. The City specifically reserves and does not vacate its interest in that certain <br />10-foot utility easement lying within the southernmost ten feet of such joint access easement. <br />Further, easements for existing public utilities, if any, shall not be altered or amended by virtue of <br />this ordinance. <br /> <br /> <br />
