Lipton moved the <br />consent agenda be approved. Mulvahill seconded. Roll Call Vote: <br />Rommelfanger - yes, Mulvahill - yes, Wilson - yes, Koertje - yes and Lipton - <br />yes. Consent agenda approved. <br />Authority Business <br />A. Findings and Order - Show Cause Hearing - The Back Room Brewery, <br /> Inc. d/b/a The Back Room - Hotel and Restaurant Liquor License - 328 <br /> S.McCaslin Blvd. - 2/13/06 Incident - <br />Chairperson Mulvahill noted the licensee, Tom Newman and the Special <br />Prosecutor, Stefan Fredericksmeyer were both present. Attorney Light reminded <br />the Authority they had taken evidence on this issue at the April meeting and had <br />directed the Attorney to prepare a draft of written findings and an order for <br />consideration at this meeting after a continuance was granted. At this time, the <br />licensee and the special prosecutor can present any evidence or final comments <br />they wish the Authority to consider in mitigation of this matter. He pointed to the <br />Rules of Procedure for the Authority concerning the things the members could <br />consider in completing the findings and order. <br />Chairperson Mulvahill asked Mr. Fredericksmeyer if he had anything to present <br />to the Authority. Mr. Fredricksmeyer chose to comment after Mr. Newman <br />except to remind the Authority there was an order from a previous violation with 2 <br />days held in abeyance. Chairperson Mulvahill inquired if Mr. Newman had any <br />items he wished to present to the Authority before their decision. Mr. Newman <br />stated he would like the Authority to consider two items. He pointed out the two <br />incidents were more than a year apart, but because of the way the order was <br />written and the fact there were two continuances granted for the hearing, the two <br />days held in abeyance come into play with this incident. He also reported he has <br />installed a camera system in his establishment. He stated the bartender in this <br />incident had attended training and he makes sure all his bartenders attend <br />training during the year. <br />Mr. Fredericksmeyer commended Mr. Newman for the steps he had taken to <br />avoid future incidents and appearances in front of the Authority. He reminded <br />the Authority of the way the previous order was written and of the two days held <br />in abeyance. He stressed the police should have been called when the incident <br />was occurring in the bar and also should have been called during the fight <br />outside the bar. <br />
