<br />Local Licensing Authority <br />Minutes <br />June 26, 2006 <br />Page 3 of 5 <br />Mr. Newman reported he had instituted a new policy concerning incidents outside <br />the bar. He has instructed his employees to stay in the bar and call the police. <br />Attorney Light reviewed the order for the past incident and asked it be made a <br />part of the record for this proceeding. No objections were voiced, so the order <br />was made a part of the record. He went over the timeline of the two incidents <br />and the previous order. Light presented the Authority's options concerning the <br />current order. <br />Chairperson Mulvahill closed the hearing. Attorney Light referred the Authority to <br />the draft copy of the findings and order. He pointed out they could word it as <br />they saw fit. <br />Authority member Wilson wanted to acknowledge Mr. Newman for installing the <br />camera and thought the Authority should take that into consideration. <br />Rommelfanger agreed and also expressed he was glad to hear Mr. Newman had <br />new policies in place concerning calling the police. There was discussion <br />concerning the length of time between the incidents and the two days held in <br />abeyance. <br />Wilson moved the Authority order the licensee to serve the two days held in <br />abeyance plus 4 days for this violation with nothing held in abeyance. <br />Rommelfanger seconded. Attorney Light noted Authority members Koertje and <br />Lipton were not present for the hearing and he suggested they abstain from <br />voting on the order. Roll Call Vote: Rommelfanger - yes, Wilson - yes and <br />Mulvahill - no. Attorney Light pointed out the Rules of Procedure state the <br />Authority can act on a majority of three members voting but would not be a <br />majority of the five member Authority, so he asked the Authority reconsider to <br />reach a consensus. <br />Rommelfanger moved the Authority reconsider the previously adopted motion. <br />Wilson seconded. All in favor. <br />Mulvahill moved the Authority adopt and approve the Findings of Fact, <br />Conclusions of Law, and Final Decisions and Order and authorize the <br />Chairperson to sign those and find the Hotel and Restaurant License for the Back <br />Room be suspended for a 7 day period for this violation with the 2 days held in <br />abeyance, those 2 days to be considered the 2 days held in abeyance from the <br />previous order. Rommelfanger seconded. Roll Call Vote: Mulvahill- yes, <br />Rommelfanger - yes and Wilson - yes. <br />Mulvahill moved the Authority reconsider the previously adopted motion to clarify. <br />Rommelfanger seconded. All in favor. <br />Mulvahill moved the Authority adopt and approve the Findings of Fact, <br />Conclusions of Law, and Final Decisions and Order and authorize the <br />Chairperson to sign those and find the Hotel and Restaurant License for the Back <br />Room be suspended for a 9 day period for this violation with 2 days held in <br />
