<br /> City Council <br /> Meeting Minutes <br /> March 21, 2006 <br /> Page 5 of 15 <br /> Ordinance No. 1490, Series 2006, is an Emergency Ordinance, and Amends <br /> Section 2.60.020 of the Louisville Municipal Code Regarding Membership of the <br /> Planning Commission and provides for an Eighth Member of the Commission for <br /> a fixed term. An emergency ordinance requires an affirmative vote of 2/3 of the <br /> City Council. <br /> Mayor Sisk asked if Council adopted the ordinance would Commissioner <br /> McAvinew be immediately reappointed. City Attorney Light confirmed he would. <br /> Mayor Sisk opened the public hearing and requested public comment. There <br /> were no comments. <br /> COUNCIL COMMENT <br /> Mayor Pro Tern Brown reported speaking to Commissioner McAvinew relative to <br /> this matter. McAvinew clarified he is interested in further service with the <br /> Planning Commission. <br /> Mayor Pro Tern Brown voiced his concern the Planning Commission would be <br /> deadlocked, and a majority vote would require a five affirmative vote. City <br /> Attorney Light stated the ordinance does not address voting procedures; it states <br /> the Planning Commission will adopt their own procedures. <br /> Mayor Pro Tern Brown asked if there are any ramifications for the action taken by <br /> the Planning Commission since January 1. City Attorney Light stated the <br /> ordinance would not affect the proceedings of past meetings. <br /> Council member Muckle also voiced his concern over an eight-member Planning <br /> Commission and asked if it would be appropriate for the Planning Commission to <br /> forward a four-four vote on a recommendation to Council. City Attorney Light <br /> stated a recommendation with a four-four vote would be forwarded to Council. <br /> Mayor Sisk explained should there be a four-four vote recommendation <br /> forwarded by the Planning Commission the City Council would still make a final <br /> determination. He stated the ordinance allows the Planning Commission to <br /> move forward for the next year and a half. He favored the emergency ordinance. <br /> There was Council consensus. <br /> Mayor Sisk closed the public hearing. <br /> MOTION: Council member Marsella moved for the approval of Ordinance No. <br /> 1490, Series 2006, as an Emergency Ordinance, seconded by Council member <br /> Sackett. Roll call vote was taken. The motion carried by a vote of 7-0. <br />
