<br /> City Council <br />Meeting Minutes <br /> April 18, 2006 <br /> Page 10 of 16 <br />Assistant City Manager Balser reviewed the professional services agreement and <br />scope of work with ERG. ERG will review the Foothills Compressor Station <br />Facility application prepared by Xcel and filed with Boulder County. The ERG <br />professionals who will work with the City are Phil Movish and Joseph Rodgers. <br />ERG proposes to provide assistance to the City on an hourly rate basis plus any <br />direct expenses at cost. The rates for Mr. Movish are $250 an hour and $215 <br />and hour for Mr. Rodgers. Staff recommended approval of a professional service <br />contract with ERG up to $10,000 from Council Contingency funds and <br />authorization for the Mayor to sign the agreement and negotiate and approve any <br />final non-substantial changes. <br />COUNCIL COMMENTS <br />Council member Marsella asked if the contract outlines the $10,000. Assistant <br />City Manager Balser stated the contract does not outline the $10,000, but if the <br />work nears $10,000, Staff will request further appropriations from the Council. <br />Council member Muckle asked for the balance of the Council Contingency funds. <br />City Manager Simmons stated the balance is somewhere in the $30,000 range. <br />He noted the City requires technical expertise on the Xcel proposal and on <br />negotiations of a settlement, if necessary. <br />Mayor Pro Tem Brown stated Louisville residents have certain expectations that <br />their properties will not be adversely impacted. <br />Mayor Sisk concurred and stated the City must take a strong stand on the issue. <br />City Manager Simmons read a letter from Mr. Movish stating he is married to a <br />Comcast official. Given the nature of the proposed engagement with the City, <br />Mr. Movish did not believe this would be a conflict of interest. <br />Council member Sackett disclosed he is a resident of the Coal Creek subdivision <br />and asked if he should recuse himself from the proceedings. <br />Mayor Sisk stated the Councilor need not recuse himself on this matter as he is a <br />resident of the neighborhood and represents Ward III. <br />Assistant City Manager Balser announced the hearing is scheduled before the <br />Boulder County Commissioners on Tuesday, May 23, 200 at 5:00 p.m. <br />Mayor Sisk requested public comment. <br />Todd Lovell, 656 Andrews Lane, Louisville, CO asked Council what citizens <br />could do to assist the City in the process. He stressed there are significant <br />safety issues. He suggested the Home Owners Association could send notice <br />
