As two more cities must sign the IGA amendment, he <br />requested Ordinance No. 1456, Series 2004 be continued. <br />Mayor Sisk opened the public hearing on Ordinance No. 1456, Series 2004, and <br />requested the comments of the City Attorney and Mr. Lopez be included. <br />COUNCIL COMMENT <br />Mayor Pro Tem Brown and Council member Marsella voiced their support for the <br />IGA amendment. <br />Council member Muckle asked if the City is obligated to rezone the property. <br />City Attorney Light stated the City was ordered by the court to annex the <br />property, but no order was made relative to the zoning. The IGA provides for the <br />property's zoning and without an amendment the land use cannot be changed. <br />Council member Muckle asked how the $14,000 per acre for open space <br />acquisitions was derived. City Manager Simmons stated the Boulder County <br />Planning Staff investigated their history of rural open space acquisitions and the <br />parties then negotiated the $14,000 per acre purchase price. <br />Council member Muckle questioned whether $14,000 per acre price would <br />actually purchase open space. He asked if all the property was purchased by a <br />developer would the City get all the open space acquisition money at once, or at <br />the time of platting. He requested in the event of a replat or a sale of the <br />property in its entirety, all the open space money be paid to the City. <br />Council member Sackett asked if the IGA amendment would permit housing <br />developments. City Attorney Light stated the IGA amendment outlines the <br />zoning for Industrial. <br />City Attorney Light explained the property is 33.7 acres and when the number of <br />developable acreage is calculated, less the 12% land dedication and right-of-way <br />dedication, the net acreage would be approximately 29 acres. <br />MOTION: Mayor Sisk moved to continue the Discussion/Direction and <br />Ordinance No. 1456, Series 2004, to May 16,2006. Mayor Pro Tem Brown <br />seconded the motion.
