<br /> City Council <br /> Meeting Minutes <br /> July 18, 2006 <br /> Page 4 of 7 <br />RESOLUTION No. 29, SERIES 2006 - A RESOLUTION REFERRING TO A <br />VOTE OF THE REGISTERED ELECTORS OF THE CITY OF LOUISVILLE AT <br />THE NOVEMBER 7,2006, SPECIAL MUNICIPAL ELECTION A TABOR <br />BALLOT ISSUE TO AUTHORIZE THE IMPOSITION OF THE CITY'S USE TAX, <br />CURRENTLY COLLECTED UPON VEHICLES AND NONRESIDENTIAL <br />CONSTRUCTION AND BUILDING MATERIALS, UPON THE USE, STORAGE, <br />DISTRIBUTION OR CONSUMPTION OF ANY SERVICES OR ANY ARTICLE <br />OF TANGIBLE PERSONAL PROPERTY, OTHER THAN RESIDENTIAL <br />CONSTRUCTION AND BUILDING MATERIALS, THAT ARE PURCHASED, <br />LEASED OR RENTED FROM SOURCES INSIDE OR OUTSIDE THE CITY, <br />FOR WHICH THE CITY SALES TAX HAS NOT BEEN PAID <br />RESOLUTION No. 30, SERIES 2006 - A RESOLUTION REFERRING TO A <br />VOTE OF THE REGISTERED ELECTORS OF THE CITY OF LOUISVILLE AT <br />THE NOVEMBER 7,2006, SPECIAL MUNICIPAL ELECTION A TABOR <br />BALLOT ISSUE TO AUTHORIZE THE IMPOSITION OF THE CITY'S USE TAX, <br />CURRENTLY COLLECTED UPON VEHICLES AND NONRESIDENTIAL <br />CONSTRUCTION AND BUILDNG MATERIALS, UPON THE USE, STORAGE, <br />DISTRIBUTION OR CONSUMPTION OF CONSTRUCTION AND BUILDING <br />MATERIALS PURCHASED AT RETAIL FOR USE IN CONNECTION WITH <br />NEW RESIDENTIAL CONSTRUCTION OR NEW RESIDENTIAL BUILDING <br />PROJECTS <br />Mayor Sisk requested a Staff presentation. <br />Finance Director Patty Leslie explained at the July 11 Study Session the City <br />Council requested staff prepare wording for two possible ballot questions to be <br />discussed at the July 18 City Council meeting. <br />The first question included in Resolution No. 29 would ask the Louisville voters to <br />consider the imposition of a use tax" Currently a use tax is collected on vehicles <br />and non-residential building materials in the amount of 3%. In addition, a sales <br />and use tax of 3/8% is currently collected for open space purchases and <br />improvements. That tax was re-authorized for ten years by the Louisville voters <br />in 2002. If approved, the use tax would apply to items subject to sales tax <br />excluding residential construction and building materials. An ordinance defining <br />specifically the items that would be subject to the tax would have to be adopted <br />by City Council. This question is the same as the question submitted to the <br />Louisville voters in November 2005 (Ballot Issue 2A). <br />The second question, included in Resolution No. 30 would ask the Louisville <br />voters to consider the imposition of a use tax on building materials purchased for <br />new residential construction. If approved, this tax would apply to building <br />materials purchased for new residential construction and building projects.
