<br /> City Council <br /> Meeting Minutes <br /> November 21, 2006 <br /> Page 6 of 17 <br /> The parcel was annexed to the City iin 1995 and zoned Single Family-Rural (east <br /> of McCaslin) and Restricted Rural - Residential (west of McCaslin). The <br /> Louisview Corporation received approval in 1998 for the Gateway Subdivision <br /> and Final PUD Development Plan. That entitlement created 7 single family lots <br /> on the east side of McCaslin ranging in lot area between 1.5 and 1.8 acres each. <br /> The applicant requests a rezoning of the property from Single-Family rural to <br /> Single-Family medium density, which has a lot size of 12,000 square feet. <br /> The public use dedication requirement is through both the conveyance of land <br /> and a cash payment. The residential portion of the subdivision conveyed to the <br /> City Outlots A, Band C for a total of 5.2 acres located adjacent to South Boulder <br /> Road. Outlot D was conveyed to thE~ Home Owners Association for detention <br /> purposes. In addition to the land dedication, the Subdivider was required to pay <br /> a cash-in-lieu payment of $25,000 dollars. <br /> The subdivision will rely on single point of access identified as Gateway Lane to <br /> McCaslin Boulevard. There is secondary emergency access to the North to <br /> South Boulder Road. The Public Works Department investigated the proposed <br /> subdivisions access. The applicant submitted eight (8) Alternative Access <br /> Considerations from Traffic Engineer Bill Fox. <br /> The Planning Commission held a special meeting to allow the applicant to re- <br /> submit the information that was requested at the August 10, 2006 meeting. The <br /> Commission asked the applicant to look at a number of issues, including density <br /> (reduction of residential units), traffic: safety, creation of a gateway feature, the <br /> aesthetic treatments of fences, and more architectural treatments of the rear of <br /> the residential features facing South Boulder Road. <br /> The Planning Commission held a public hearing regarding the application on <br /> September 21,2006. The proposal Game back with no reduction of residential <br /> units, a traffic report stating the access will work with an adequate level of service <br /> for the subdivision. The Planning Commission was unanimous in the support of <br /> the architectural design, the quality of construction, the build green and the solar <br /> technology of the proposed subdivision. There was also discussion as to the <br /> value of the dedication of the 4.8 acre parcel to the City. The final discussion <br /> points were that traffic safety was a concern and the proposal was too dense. <br /> There was a division of the Planning Commission by a 4-4 vote. Some <br /> Commissioners stated the proposed density was in compliance with the <br /> Comprehensive Plan and traffic access would generally function at an acceptable <br /> level of service for the neighborhood. <br /> Mayor Sisk asked if the applicant filed their appeal within the allotted timeframe. <br /> Planning Director Wood confirmed the appeal was filed within fifteen days. <br /> Mayor Sisk requested an Applicant presentation. <br />
