<br /> The City may inspect the equipment and facilities of any <br /> user at any time during normal business hours to ascertain whether <br /> they are in compliance with applicable ordinances, rules and <br /> regulations. In the case of emergency the City may cause such <br /> inspection to occur at any time. Occupants of premises where <br /> wastewater is created or discharged shall allow the City or its <br /> representative entry for purpose of inspection, sampling, records <br /> examination or the performance of any other rights or <br /> responsibilities under this chapter. The City, State and EPA shall <br /> have the right to set up on the user's property such devices as are <br /> necessary to conduct sampling inspection, compliance monitoring, or <br /> metering operations. Where a user has security measures in force <br /> which would require proper identification and clearance before entry <br /> into their premises, the user shall make necessary arrangements with <br /> their security force/system so that upon presentation of suitable <br /> identification, personnel from the Ci ty, State and EPA will be <br /> permitted to enter, without delay, for the purposes of performing <br /> their specified responsibilities. <br /> In the event a duly authorized officer or agent of the City <br /> is refused admission for any purpose, the City may cause sewer <br /> service to the premises in question to be discontinued until the <br /> City's officer or agent has been afforded reasonable access to the <br /> premises and sewer system to accomplish the inspection or sampling. <br /> All measurements, tests and analysis of the characteristics <br /> of wastewater to which reference is made herein shall be determined <br /> in accordance with Standard Methods or, where not addressed in <br /> Standard Methods, in accordance with procedures established by the <br /> EPA pursuant to Section 304(h) of the Act [33 U.S.C. Section <br /> 1314(h)], or with any other test procedures approved by the EPA <br /> Administrator. In the event that no special facility has been <br /> required, the point of inspection shall be the downstream manhole in <br /> the POTW sewer nearest to the point at which the building sewer is <br /> connected to the public sewer. All measurements, tests, and <br /> analysis, and all sampling shall be at the expense of the user. <br /> 13.32.090 Pretreatment <br /> Users shall provide necessary wastewater treatment as <br /> required to comply herewith. Any equipment and facilities required <br /> to pretreated wastewater to a level in compliance with this ordinance <br /> shall be provided, operated and maintained at the user's expense. <br /> Detailed plans showing the pretreatment facilities and operating <br /> procedures shall be submitted to the City for review, and shall be <br /> approved in writing by the City before construction of the facility. <br /> The review of such plans and operating procedures will in no way <br /> relieve the user from the responsibility of modifying the facility as <br /> necessary to produce wastewater :Ln compliance with the provisions of <br /> this ordinance. Any subsequent ehanges in the pretreatment <br /> facilities or method of operation shall be reported to the City and <br /> approved prior to the user's initiation of the changes. <br /> 13.32.100 List of Non-Complying Users <br /> The City may annually publish in one or more newspapers a <br /> list of users which were not in compliance with any applicable <br /> requirements or standards at least once during the twelve previous <br /> months. Such notification shall also summarize any enforcement <br /> actions taken against such users during the same twelve months. All <br /> records relating to compliance with applicable standards or <br /> requirements shall be made available to officials of the EPA or <br /> Approval Authority upon request, subject to any limitations contained <br /> in State Statutes. <br /> Information and data on a user obtained from reports, <br /> questionnaires, permit applications, permits and monitoring programs <br /> and from inspections shall be available to the public or other <br /> governmental agency without restriction unless the user specifically <br /> requests and is able to demonstrate to the satisfaction of the City <br /> -.14- <br />
