<br /> When requested by the user furnishing a report and such <br /> request is approved by the City, the portion of a report which might <br /> disclose trade "secrets" or "secret processes" shall not be made <br /> available for inspection by the public but shall be made available <br /> upon written request to governmental agencies for uses related <br /> hereto, the National Pollutant Discharge Elimination System (NPDES) <br /> Permit, or applicable standards or requirements. Moreover, such <br /> portions of the report shall be available for use by the City, State, <br /> or any State agency in judicial review or enforcement proceedings <br /> involving the user furnishing the report. <br /> Information accepted by the City as confidential, shall not <br /> be transmitted to any government agency by the City until and unless <br /> a ten day written notification is given to the user by certified mail <br /> or personal service. <br /> 13.32.110 - Fees and Charges <br /> It is the purpose of this chapter to provide for the <br /> recovery of costs from Users of the City's wastewater disposal system <br /> for the implementation of the program established herein. The <br /> applicable charges or fees shall be set in this ordinance which are <br /> in addition to sewer use fees and charges and sewer tap fees as set <br /> forth in the Louisville Municipal Code. <br /> A. Damage to Facilities. When a user's wastewater causes <br /> obstruction or damage:- or because of the nature of the wastewater, <br /> increases the costs for managing the effluent or the sludge of the <br /> POTW, the user shall pay for such increased costs. <br /> B. Wastewater Discharge Permit Fees. Critical industries <br /> shall be subject to wastewater discharge permIt fees as set forth <br /> below: <br /> Class I <br /> - <br /> Significant contributor: Industries which are classified <br /> as Categorical Industries and due to the nature of their wastewater <br /> discharge are governed by National Categorical Pretreatment <br /> Standards. This includes but is not limited to electroplating and <br /> chemical milling and etching. <br /> Class II <br /> - <br /> Potential contributor: Industries which may be classified <br /> as categorical industries and the nature of their processes are such <br /> that priority pollutants are not discharged under normal operations. <br /> Subclass A - Metal finishing processes which include but are not <br /> limited to: anodizing, coating, chemical etching and <br /> milling. <br /> Subclass B - Chemical cleaning processes which include but are not <br /> limited to: vapor degreasers and petroleum product <br /> degreasers. <br /> Subclass C - Non-chemical, detergent cleaning processes which are <br /> discharged directly into the sewer system. This <br /> includes but is not limited to: metal deburring <br /> and vat cleaning. <br /> Subclass D - Storage of oil, gasoline or any chemical or substance <br /> in amounts over 100 gallons which could violate any <br /> of the provisions of Section 13.32.040(a). This <br /> includes but is not limited to warehouses and <br /> gasoline stations. <br /> -15- <br />
