COUNCIL INFORMATIONAL COMMENTS ON PERTINENT ITEMS NOT ON <br /> THE AGENDA <br /> <br />Davidson reported that he received a letter from Judge Weinberg regarding the City's <br />request for him to issue an opinion on a potential violation of the ethics ordinance. He <br />read from the letter: <br /> <br />The Judicial Conduct, which establishes principles of conduct for municipal <br />judges, Canon 3, prohibits a judge from commenting upon pending or impending <br />proceedings. <br /> <br />Davidson stated that, therefore, Judge Weinberg couldn't issue an opinion on a potential <br />violation of the ethics ordinance. Davidson explained that he has written a letter to the <br />Boulder County District Attorney requesting that the DA's office take up the issue, as <br />State Statute on this equals or is more stringent than the Louisville Ethics Ordinance. <br />Davidson explained that he expects to receive afindings of facts from the Boulder County <br />District Attorney, in addition to a decision on whether further legal actions are required. <br />He stated that the District Attorney is an independent source, which would satisfy <br />requests by several members of Council and Councilman Lathrop for an independent <br />review. Davidson explained that he voted to remove Agenda Item H because it is about to <br />be considered under a potential prosecution and he did not want to jeopardize that. <br /> <br />Sisk asked to read letter received by Mayor Davidson and Bill Simmons regarding the <br />Outback Steak House: <br /> <br />I want to let you know how incredibly accommodating Coal Creek Golf Course <br />management was before and during our Outback Scramble for the Scout Reach <br />Tournament. Staff, Jim Hughes, including Bill Peschte, Tony Rozalas and Dan <br />Johnson, were very organized and professional at all times. We got several <br />comments from surprised participants on hearing Coal Creek is a public course <br />and on the immaculate maintenance of the course and courteousness of the staff <br />Thank you and your facility for participating itt Scout Reach.
