ORDINANCE No. 1300, SERIES 1999 - AN ORDINANCE APPROVING <br />THE VACATION OF CERTAIN EASEMENTS IN CENTURY RETAIL <br />CENTER, A SUBDIVISION IN THE CITY OF LOUISVILLE -public <br />hearing (published Daily Camera 5/22/99) <br /> <br />Davidson called for City Attorney introduction. <br /> <br />Sam Light, City Attorney, read by title only, Ordinance No. 1300, Series 1999 - An <br />Ordinance Approving the Vacation of Certain Easements in Century Retail Center, a <br />Subdivision in the City of Louisville. <br /> <br />Davidson called for staff presentation. <br /> <br />Ken Johnstone, Principal Planner, stated that as part of the 1998 replat and PUD <br />amendment for Century Retail Development, there were various access, utility and <br />drainage easements that were relocated or modified. He stated that new easements have <br />been formalized and recently recorded with the replat of Century Retail. He explained, <br />that consistent with a condition of approval on the replat, the City is able to act on an <br />ordinance that would vacate all the easements that were originally recorded on the first <br />subdivision plat for the subdivision by approving and adopting Ordinance No. 1300, <br />Series 1999. <br /> <br />Davidson opened the public hearing and called for anyone wishing to speak on Ordinance <br />No. 1300, Series 1999 - An Ordinance Approving the Vacation of Certain Easements in <br />Century Retail Center, a Subdivision in the City of Louisville. <br /> <br />NONE <br /> <br />Davidson closed the public hearing and called for Council comments and questions. <br /> <br />Sisk asked Johnstone for clarification that a separate shared parking agreement for the <br />mutual benefit of Lots 1 and 2 has been recorded, as this was also a condition of <br />approval. <br /> <br />Johnstone replied, yes. <br /> <br />Sisk asked for clarification that the other condition of approval would have been the <br />recording of an easement vacation by Ordinance No. 1300. <br /> <br />Johnstone explained that in the original resolution of approval, it was stated that the <br />easements would be vacated prior to recording of the replat. However, the City <br />Attorney's office advised switching the recording order so that easements were always in <br />place. <br /> <br />Sisk asked Johnstone whether staff approved the shared parking agreement. <br /> <br />7 <br /> <br /> <br />
