Johnstone replied yes, and stated that the City Attorney also reviewed the agreement. <br /> <br />Sam Light, City Attorney, explained that the reason for the change in timing was because <br />some of the easements that are being vacated did connect to other easements on other <br />properties. <br /> <br />Lathrop moved that Council approve Ordinance No. 1300, Series 1999 - An Ordinance <br />Approving the Vacation of Certain Easements in Century Retail Center, a Subdivision in <br />the City of Louisville, seconded by Levihn. <br /> <br />Roll call was taken. Motion passed by a vote of 6-0, with Howard being absent. <br /> <br />RESOLUTION No. 30, SERIES 1999 - A RESOLUTION APPROVING A <br />PURCHASE AGREEMENT TO BUY AND SELL VACANT REAL ESTATE AND <br />CONSERVATION EASEMENT - <br />public hearing (advertised Daily Camera 5/9/99) <br /> <br />Sisk requested to be excused from the discussion on Agenda Items 6C, 6D, and 6F due to <br />a conflict of interest. <br /> <br />Davidson excused Sisk and called for staff presentation. <br /> <br />Bill Simmons, City Administrator, stated that Resolution No. 33, Series 1999 would <br />approve a purchase agreement between the City of Louisville and Boulder County under <br />which the County would purchase from the City a one-half undivided interest in the <br />parcel referred to as the Admor West Parcel. The purchase and sale of the one-half <br />undivided interest to the County would also include a one-half undivided interest in the <br />development rights of 6.6 units for the Admor West Parcel. The purchase price is <br />$375,000 and does not include the sale of any water rights. He stated that should the <br />development rights be sold the County and the City of Louisville would share fifty/fifty <br />in the proceeds from the sale. The purchase agreement calls for the County and City of <br />Louisville to exchange reciprocal conservation easements for the purposes of preserving <br />and protecting for scenic, open space, agricultural, passive recreational and <br />environmental uses, the natural condition and aesthetic and ecological features of the <br />Admor West Parcel. <br /> <br />Davidson opened the public hearing and called for anyone wishing to speak on <br />Resolution No. 30, Series 1999 - A Resolution Approving a Purchase Agreement to Buy <br />and Sell Vacant Real Estate and Conservation Easement. <br /> <br />NONE <br /> <br />Davidson closed the public hearing and called for Council comments and questions. <br /> <br /> <br />
