Lathrop asked for additional details on the berm, and asked Wood whether he could provide
a cross-section of the berm.

Wood replied that there is a cross-section in the Council packet.

Lathrop asked Wood whether this berm would screen the headlights of the tractor-trailers
that would be arriving to the facility after dark.

Wood replied that he believes that it will. He suggested that the City reserve the right to
adjust it if it doesn't work.

Lathrop explained that his concern is due to his experience with the individuals under
contract with the US Postal Service to haul mail. He stated that they are the most
discourteous group that he has ever come in contact with. He requested that every attempt
be made to minimize the impact from the tractor-trailers that he suspects will be arriving at
all hours. He expressed concern that the wall would not be able to adequately block the
lights of the tractor-trailers as they back into the loading docks. He recommended extending
the wall.

Ballard replied that he would prefer to build the wall correctly now versus addressing the
problems later and expressed willingness to extend the wall.

Levihn agreed with Lathrop. He asked Ballard whether the tractor-trailers would need to use
their headlights, as the area is so highly lit.

Ballard replied, no. However, he questioned how to control the use of headlights.

Levihn suggested installing a sign at the entrance requesting that drivers turn off their
headlights.

Ballard stated that they could do that.

Levihn suggested placing this requirement on the PUD.

Davidson thanked Ballard for attending tonight's meeting. He asked Wood, since the US
Postal Service proposal does not meet the Commercial Development Design Standards &
Guidelines, whether there is a note on the PUD that states that this approval applies to this
owner only. He explained that, should the US Postal Service decide to sell the building, any
future owners would be required to bring it up to the Commercial Development Design
Standards & Guidelines.

Wood replied, no, there is not a note on the PUD.

Davidson asked Sam Light, City Attorney, whether such a note could be legally placed on
the PUD.

13
