Light replied that the premise for some of the variances from the Commercial Development <br />Design Standards & Guidelines are based on the Federal laws that provide the US Postal <br />Service some relief from local zoning requirements. Therefore, it would be appropriate in <br />the event of a change of ownership to have a note that states that the property must be <br />brought into compliance with the laws that do not apply to the US Postal Service. He stated <br />that he believes there is case law to support this. <br /> <br />Davidson thanked the Planning Department staff, Planning Commission, and the US Postal <br />Service for making as many modifications as possible to bring the project close to the <br />Commercial Development Design Standards & Guidelines. He agreed with Lathrop <br />regarding the wall. He agreed with Levihn's suggestion to install a sign requesting that <br />tractor-trailers turn off their headlights. <br /> <br />Bill Simmons, City Administrator, asked Ballard whether there is a gate for the east side of <br />the dumpster. <br /> <br />Ballard replied, yes. <br /> <br />Wood replied that he could not locate one. <br /> <br />Ballard replied that there would be one. <br /> <br />Simmons asked Ballard for the color of the overhead doors. <br /> <br />Ballard replied that they are proposed to be beige to coordinate with the adjoining wall <br />panels. He agreed to change the color, if it is not beige. <br /> <br />Sisk asked for clarification that Ballard would agree with all conditions of approval. <br /> <br />Sisk expressed concern for the wording in condition number three. Specifically that the plan <br />will comply with Commercial Development Design Standards & Guidelines lighting <br />requirements to the extent possible under Federal regulations. He asked for clarification that <br />Federal regulations would take precedence. He questioned the statement No light spillage <br />shall be allowed in the Dahlia Street right-of-way that was also included in the condition, as <br />he thought that there would be light spillage onto the Dahlia Street right-of-way. <br /> <br />Ballard replied that there is less than one foot-candle of light spillage at the property line. <br /> <br />Sisk repeated that the condition states that there will be no light spillage, however, he <br />believes that there will be. <br /> <br />Wood stated that it might be necessary to accept medium standards on-site but questioned <br />why the impact of those standards should be accepted on Dahlia Street. <br /> <br />14 <br /> <br /> <br />
