II HMI 11111111111 IIII 2613677 <br /> Boulder County Clerk, CO CE R 71 00 D 0 00 <br /> 3.2.2 The existing buildings and structures upon the Property may remain in place <br /> and may be reconstructed and replaced. Any reconstructed or replacement structure <br /> shall be limited to the size existing as of the date of this Easement and shall be in the <br /> same location and of the same dimensions, and of substantially similar architectural <br /> style, as the prior structure. Notwithstanding the foregoing, the City Director of <br /> Planning may approve alterations in the location and architectural style for <br /> reconstructed or replacement buildings. <br /> 3.3 There shall be no dumping or storage of ash, trash,junk, rubbish, sawdust, garbage, <br /> chemicals,or other unsightly or offensive materials on the Property. The Owner shall <br /> completely screen from view from 104th Street any outdoor storage of supplies and <br /> materials used in connection with Existing Uses of the Property,which screening shall <br /> comply with current City standards. No supplies and materials shall be stored at a <br /> height greater than any screen fence. Within six months of the date of recording of this <br /> Agreement, Owner shall at its expense install a screen fence in a location mutually <br /> acceptable to Owner and City, and shall reduce the stack heights of supplies and <br /> materials stored outdoors, in order to comply with the provisions of this Section 3.3. <br /> 3.4 There shall be no changing of the topography of the Property through dredging or <br /> filling, or the placing of soil or other substances,materials,or landfill on the Property, <br /> except that changes in topography, cut and fill, and removing and placing of soils are <br /> permitted only to the extent necessary for irrigation of the Property and for <br /> reconstruction or replacement of structures permitted by this Easement. <br /> 3.5 There shall be no setting of any fire on the Property. <br /> 3.6 There shall be no sand, gravel, rock, oil, gas or mineral exploration, extraction, or <br /> development upon or under the Property unless otherwise required by law. <br /> 3.7 There shall be no erection, construction, installation, relocation or use upon the <br /> Property of a communication facility,a telecommunication facility,a network element, <br /> telecommunications equipment, or any other equipment or material that may be used <br /> for telecommunications or to provide telecommunications services as such terms are <br /> defined in the Federal Telecommunications Act of 1996. This prohibition shall not <br /> apply to a satellite dish or telecommunication equipment for the provision of services <br /> to only a permitted building upon the Property, subject to applicable regulations. <br /> 3 8 There shall be no construction,placement, or erection of any signs or billboards upon <br /> the Property, except that this prohibition shall not apply to "for sale" signs for the <br /> Property, flags, property identification signs, and signs authorized by the City in <br /> connection with a permitted use of the Property. All signs shall meet the size <br /> limitations and other criteria of the Louisville sign code and design guidelines. <br /> 4. Other Proposed Uses or Structures. The City shall have the right to review and approve <br /> or deny applications from the Owner for uses or structures neither expressly permitted nor specifically <br /> prohibited by this Easement but which may be conducted in a manner consistent with <br /> 3 <br />
