Any reconstructed or replacement structure shall be limited to the size existing as of the date of this Easement and shall be in the same location and of the same dimensions, and of substantially similar architectural style, as the prior structure. Notwithstanding the foregoing, the City Director of Planning may approve alterations in the location and architectural style for reconstructed or replacement buildings. 3.3 There shall be no dumping or storage of ash, trash,junk, rubbish, sawdust, garbage, chemicals,or other unsightly or offensive materials on the Property. The Owner shall completely screen from view from 104th Street any outdoor storage of supplies and materials used in connection with Existing Uses of the Property,which screening shall comply with current City standards. No supplies and materials shall be stored at a height greater than any screen fence. Within six months of the date of recording of this Agreement, Owner shall at its expense install a screen fence in a location mutually acceptable to Owner and City, and shall reduce the stack heights of supplies and materials stored outdoors, in order to comply with the provisions of this Section 3.3. 3.4 There shall be no changing of the topography of the Property through dredging or filling, or the placing of soil or other substances,materials,or landfill on the Property, except that changes in topography, cut and fill, and removing and placing of soils are permitted only to the extent necessary for irrigation of the Property and for reconstruction or replacement of structures permitted by this Easement. 3.5 There shall be no setting of any fire on the Property. 3.6 There shall be no sand, gravel, rock, oil, gas or mineral exploration, extraction, or development upon or under the Property unless otherwise required by law. 3.7 There shall be no erection, construction, installation, relocation or use upon the Property of a communication facility,a telecommunication facility,a network element, telecommunications equipment, or any other equipment or material that may be used for telecommunications or to provide telecommunications services as such terms are defined in the Federal Telecommunications Act of 1996. This prohibition shall not apply to a satellite dish or telecommunication equipment for the provision of services to only a permitted building upon the Property, subject to applicable regulations. 3 8 There shall be no construction,placement, or erection of any signs or billboards upon the Property, except that this prohibition shall not apply to "for sale" signs for the Property, flags, property identification signs, and signs authorized by the City in connection with a permitted use of the Property. All signs shall meet the size limitations and other criteria of the Louisville sign code and design guidelines. 4. Other Proposed Uses or Structures. The City shall have the right to review and approve or deny applications from the Owner for uses or structures neither expressly permitted nor specifically prohibited by this Easement but which may be conducted in a manner consistent with 3
