<br /> construction, or faulty or inadequate facilities; <br /> j) Environmental contamination of buildings or property; <br /> k.5) The existence of health, safety, or welfare factors requiring high levels of municipal <br /> services or substantial physical and underutilization of vacancy of sites, buildings, or <br /> other improvements. <br /> I) If there is no objection of such property owner or owners and the tenant or tenants of <br /> such owner or owners, if any, to the inclusion of such property in an urban renewal <br /> area, "blighted area" also means an area that, in its present condition and use and, by <br /> reason of the presence of anyone of the factors specified in paragraphs (a) to (k.5) <br /> above, substantially impairs or arrests the sound growth of the municipality, retards <br /> the provision of housing accommodations, or constitutes an economic or social <br /> liability, and is a menace to the public health, safety, morals or welfare. The only qualifying condition, which was not identified, was" defective <br /> or unusual conditions of title rendering the title non-marketable. " <br />3.0 Relationship to Comprehensive Plan <br /> A general plan for the City, known as the City of Louisville Comprehensive Plan 2005 <br /> Update, was adopted in 2005 (the "Comprehensive Plan"). The Comprehensive Plan <br /> specifically incorporates and included the Highway 42 Revitalization Area Comprehensive <br /> Plan, as a subarea plan including a recent amendment to the subarea plan regarding <br /> conceptual street layouts in the area. That plan also states" As developable land becomes <br /> scarcer, underutilized commercial areas will provide opportunities for redevelopment <br /> and revitalization that promote economic growth while preserving land use entitlements <br /> and property values of adjacent areas." Policy LU-3.
