<br /> RESOLUTION NO. 56 <br /> SERIES 2006 <br />A RESOLUTION APPROVING THE HOYLE PROPERTY AMENDMENT TO THE <br />SOUTHEAST BOULDER COUNTY, SOUTH 96TH STREET, DILLON ROAD AND US <br />287 AREA COMPREHENSIVE DEVELOPMENT PLAN INTERGOVERNMENTAL <br />AGREEMENT <br /> WHEREAS, the City of Louisville, City of Lafayette, City and County of Broomfield and <br />County of Boulder are parties to the Southeast Boulder County, South 96th Street, Dillon Road <br />and US 287 Area Comprehensive Development Plan Intergovernmental Agreement, dated <br />February 18, 1999, as previously amended (hereinafter the "Plan" or "IGA"); and <br /> WHEREAS, there has been proposed an amendment to the IGA entitled the "Hoyle <br />Property Amendment to Southeast Boulder County, South 96th Street, Dillon Road and US 287 <br />Area Comprehensive Development Plan Intergovernmental Agreement," (hereinafter the <br />"Amendment"), a copy of which is attached hereto; and <br /> WHEREAS, the Amendment is proposed to permit consideration of the landowners' <br />application for Louisville Industrial zoning for the Hoyle Property, as such property is further <br />described in the Amendment, and to pennit approval of such application subject to certain <br />requirements if the City Council of the City of Louisville, after completing the processing of the <br />application and holding the requisite public hearings and in the exercise of its decision-making <br />authority, finds that the application meets the standards of the Louisville Comprehensive Plan <br />and Louisville Municipal Code, understanding that approval of the Amendment is not a <br />determination by the City or any other party to the IGA that the application meets such standards; <br />and <br /> WHEREAS, the City is authorized to execute the proposed Amendment pursuant to C.R.S. <br />929-20-101 et seq., which authorizes the parties to the IGA to cooperate and contract with each <br />other for the purpose of planning and regulating the development of land by means of a <br />"comprehensive development plan"; and <br /> WHEREAS, pursuant to c.R.S. 929-20-105, the City Council has held a public hearing on <br />the proposed Amendment after proper notice:; and <br /> WHEREAS, the City Council by this Resolution desires to approve the Amendment and <br />authorize its execution subject to the terms and conditions herein. <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF LOUISVILLE, COLORADO: <br /> Section 1. The proposed Hoyle Property Amendment to Southeast Boulder County, <br />South 96th Street, Dillon Road and US 287 Area Comprehensive Development Plan <br />Intergovernmental Agreement (the "Amendment"), a copy of which is attached hereto and <br />incorporated herein by this reference, is hereby approved. <br />
