<br /> RESOLUTION NO. 57 <br /> SERIES 2006 <br /> A RESOLUTION APPROVING A FINAL SUBDIVISION PLAT AND A FINAL <br /> PLANNED UNIT DEVELOPMENT (PUD) PLAN FOR THE NORTH END <br /> DEVELOPMENT <br /> WHEREAS, there has been submitted to the Louisville City Council an <br />application for approval of a final subdivision plat and final planned unit development (PUD) <br />plan for the proposed North End development on a 73-acre parcel of land located in northeast <br />Louisville; and, <br /> WHEREAS, all materials related to the final subdivision plat and final planned unit <br />development (PUD) plan have been reviewed by City Staff and the Planning Commission and <br />found, subject to conditions, to be in compliance with the Louisville zoning ordinances, <br />subdivision regulations, related policies and previous approvals; and <br /> WHEREAS, the City Staff has reviewed the information submitted and found that, <br />subject to conditions, the application complies with the Louisville zoning and subdivision <br />regulations and other applicable sections of the Louisville Municipal Code; and, <br /> WHEREAS, after duly noticed public hearing where evidence and testimony was entered <br />into the record, including without limitation the findings in the Louisville Planning Commission <br />Staff Reports dated September 14, 2006, the City of Louisville Planning Commission approved a <br />resolution to forward a recommendation of approval, with conditions to the City Council; and, <br /> WHEREAS, City Council has revi,ewed the application, including the recommendation <br />of the Planning Commission and finds that said final subdivision plat and final planned unit <br />development (PUD) plan should be approved, subject to the following conditions: <br />1. The Subdivider shall enter into an agreement with the Goodhue and Davidson Ditch <br /> Companies which acknowledges the existing prescriptive easement, provides for vacation of <br /> such easement in consideration of the express irrigation easements as shown on the plat, and <br /> which references the location of the pipes and trail corridor within the project. The <br /> agreement shall be subject to City review and recorded at or prior to recording of the plat. <br />2. Subdivider shall modify the final subdivision plat to incorporate those revisions as identified <br /> in November 20, 2006 Public Works Memorandum. <br />3. Subdivider shall modify note #16 on the final subdivision plat to remove the last two <br /> sentences of the note. <br />
