<br /> punishment by imprisonment and trial by jury shall not be available, no arrest <br /> warrant shall issue for failure to payor appear, and for which a penalty <br /> assessment notice shall be issued. The municipal court shall follow the state <br /> municipal court rules in such cases unless such rules are clearly inapplicable. <br /> For any violation ofthis chapter, the court may enter a judgment ofliability <br /> by default against the defendant for failure to appear or to pay, and may <br /> assess such penalty, together with such court costs and surcharges, as are <br /> established by law. The court may establish by written order, rules and <br /> regulations for the administration of any violation of any provision of this <br /> chapter, including but not limited to schedules no less restrictive than A, <br /> above, establishing the amount of penalties payable without a court <br /> appearance. <br />C. Nothing in this chapter shall be construed to impair or limit any civil or <br /> criminal prosecution for any violation of any other provision of this code, or <br /> limit or impair the penalties that may be imposed in connection therewith. <br />Section 2. Section 4.01.020 of the Louisville Municipal Code is hereby amended by the <br />addition of an introductory paragraph immediately following the title of such Section, and by the <br />addition of a new Subsection 4.01.020.E to read as follows (words added are underlined): <br />Sec. 4.01.020. Definitions. <br /> For the purposes of this title, and except as provided in Section 4.04.010, the <br />following words or phrases shall have the following meanings: <br />E. Director shall mean the Director of Land Management for the City of <br />Louisville, and such person's designees. <br />Section 3. Section 14.08.050 ofthe Louisville Municipal Code is hereby amended to read as <br />follows (words added are underlined; words deleted are stricken through): <br />Sec. 14.08.050. Parks. and apen spaee. <br /> Parks means and includes all park land, as defined in Section 1-1 ofthe home rule charter <br />and all grounds, roadways, avenues, open space, parking lots, and areas and recreation <br />facilities therein. <br />Section 4. If any portion of this ordinance is held to be invalid for any reason, such <br />decisions shall not affect the validity of the remaining portions of this ordinance. The City Council <br />hereby declares that it would have passed this ordinance and each part hereof irrespective ofthe fact <br />that anyone part be declared invalid. <br /> 9 <br />
