Rules and regulations promulgated by the <br />Director, and as may be modified by City Council, shall remain in effect until specifically <br />rescinded by the Director or City Council. <br />Sec. 4.04.090 Closures. <br /> The City Council may designate all or any portion of an Open Space area as <br />closed temporarily, permanently, or for an indefinite period of time. Also, the <br />Director may from time to time close all or a portion of an Open Space area to the <br />public or to certain animals, or both, as the Director determines necessary or <br />desirable due to wildlife, vegetation, management review, contractual agreement or <br />public safety concerns. A closure by the Director may be for a temporary, fixed <br />period of time or for an indefinite period of time. Within two business days of <br />making a decision to close an Open Space area, the Director shall send notification of <br />the closure to the City Council. The City Council may, at a regularly scheduled <br />meeting, rescind or modify the decision of the Director. It shall be unlawful for any <br />unauthorized person to enter Open Space areas that are closed. All closures, whether <br />temporary, permanent, or indefinite, and whether by the Director or by the Council, <br />shall be posted at the Open Space subject to the closure. <br />SecA.04.100 Violation; penalty. <br />A. It is unlawful for any person to violate any of the provisions of this chapter. <br /> Violation of any provision of this chapter shall be deemed a civil infraction <br /> for which imprisonment is not a possible penalty and for which the sole <br /> penalty provided shall be a fine. The following schedule of fines shall be <br /> used for violations of the provisions of this chapter: <br /> 1. Assessment for violation of provisions of this chapter concerning <br /> firearms and fire related conduct: <br /> First offense: $50 <br /> Subsequent Offenses: $100 minimum, with permissible amount to the <br /> maximum allowable by law. <br /> 2. Assessment for violations of any other provisions of this chapter: <br /> First Offense: $25 <br /> Second Offense: $50 <br /> Third Offense: $100 <br /> Subsequent Offenses: $200 minimum, with permissible amount to be <br /> maximum allowable by law. <br />B.
