The proposed high quality of the development should add to the character of this area and <br />help to encourage investment in high quality industrial and corporate facilities on the <br />surrounding properties. The value of the restaurant as an amenity to the industrial park <br />should also add to the success and marketability of the surrounding industrial/R&D <br />developments. <br /> <br />That the use/development is adequate for the internal efficiency of the proposal, <br />considering the functions of residents, recreation, public access, safety and such <br />factors including storm drainage facilities, sewage and water facilities, grades, <br />dust control and such other factors directly related to public health and <br />convenience; <br /> <br />Staff has not found any conflicts with the public health and safety that are internal to the <br />proposal. <br /> <br />That external effects of the proposal are controlled, considering compatibility of <br />land use; movement or congestion of traffic; services, including arrangement of <br />signs and lighting devices as to prevent the occurrence of nuisances; landscaping <br />and other similar features to prevent the littering or accumulation of trash, <br />together with other factors deemed to affect public health, welfare, safety and <br />convenience; <br /> <br />In general, Staff has not found negative external effects from this proposal. Staff has <br />raised one issue regarding the compatibility of this use with a potential new road that <br />could be very near the west property line of this facility. The applicant has been advised <br />of that possible conflict and does not believe it will be an issue. Additionally, the <br />proximity of the railroad tracks could be perceived as incompatible with a 'fine-dining', <br />destination restaurant. Similarly, the applicant does not believe noise from the railroad <br />tracks is a detriment to the location. <br /> <br />That an adequate amount and proper location of pedestrian walks, malls and <br />landscaped spaces to prevent pedestrian use of vehicular ways and parking <br />spaces and to separate pedestrian walk, malls and public transportation loading <br />places from general vehicular circulation facilities. <br /> <br />Staff has found this criterion to be well addressed by the applicant pedestrian plan and <br />auto circulation system. Staff has recommended some additional lighting to further <br />address this criterion. <br /> <br />The Planning Commission held a public hearing on August 10 and recommended <br />conditional approval by a vote of 3 to 2. The split vote was related to the tower issue, as <br />the members present were all in support of the overall concept of the application. There <br />were 15 conditions in Planning Commission Resolution 4/35. Several of those are <br />'tracking' conditions that would typically remain in place in the City Council resolution. <br />However, there are also several design-related conditions that have not been fully met in <br />the revised plans and therefore remain as recommended conditions in the City Council <br /> <br />14 <br /> <br /> <br />
