resolution. The applicant's response letter of September 2 acknowledges that they agree <br />to comply with the conditions. The following conditions remain: <br /> <br />1. That, if determined necessary by the City, the applicant shall apply for a 1041 Permit <br /> for this proposed development, and that no building permits shall be issued prior to <br /> approval of said permit by City Council. <br />2. That the final design of the main pedestrian path, as it connects into the public <br /> sidewalk, shall be subject to Public Works Department review and approval. <br />3. That, if the proposed 10-foot grading and landscape easement is approved on the <br /> adjacent lot to the east, the proposed easement language shall be subject to City <br /> Administrator review and approval prior to recording, and that recording of the <br /> easement shall occur prior to or concurrent with recording of the PUD/Special <br /> Review Use. <br /> That details of the screen wall and gate shall be provided to verify the design is <br /> consistent with the building architecture, including the use of stone, and that heavier <br /> landscaPe plantings be provided adjacent to the wall, if determined necessary, subject <br /> to City Administrator review and approval. <br />5. That one additional street tree be provided to the south of the southern of the two <br /> entry drives. <br />6. That some additional detailing and additional stone shall be added at the base of the <br /> south-facing wall of the kitchen wing of the facility. <br />7. That no exterior lighting of the tower shall be allowed, and that interior lighting in the <br /> tower shall be limited to the minimum necessary for the reasonable use of the <br /> stairwell. <br />8. That the copper roof shall be allowed and, if possible, encouraged to weather and <br /> oxidize in a patina finish. <br />9. That details of all exterior light fixtures are shown on the photometric site plan, and <br /> that the light fixtures at the main drop off are redesigned so that area meets the 1.0 <br /> minimum foot-candle requirement, subject to City Administrator review and <br /> approval. <br /> 10. That the grading proposed in the easement on the western property line receive all <br /> necessary approvals from the Northern Colorado Water Conservancy District. <br /> 11. That prior to issuance of a building permit, the applicant records with the Boulder <br /> County Clerk and Recorder a standard covenant agreement to treat these two lots as <br /> one for grading, drainage, zoning and building code purposes. <br /> 12. That, prior to issuance of any building permits for the project, the applicant negotiates <br /> and secures cross parking agreements with neighboring property owner(s). <br /> <br />4~ <br /> <br />Sisk called for the applicant presentation. <br /> <br />Todd Schneider, Overlook Land Company, thanked the Council, Planning Commission <br />and City staff for all their comments and suggestions. He stated that there is an <br />architectural element, previously referred to as a 'tower' that has been discussed. He <br />requested that Council consider additional information and detailing on this architectural <br />element.
