ORDINANCE No. 1309 - AN ORDINANCE AMENDING ORDINANCE No. 501, <br />SERIES 1976 TO ELIMINATE THE GEOLOGIC HAZARD AREA FOR <br />OUTLOT 1, LOT 5, BLOCK 7, THE BUSINESS CENTER AT C.T.C. - Ist Reading <br />- Set Public Hearing 10/5/99 <br /> <br />Keany moved that Council set Ordinance No. 1309, Series 1999 An Ordinance <br />Amending Ordinance No. 501, Series 1976 to Eliminate the Geologic Hazard Area for <br />Outlot 1, Lot 5, Block 7, the Business Center at C.T.C. out for publication and set the <br />public hearing for October 5, 1999, seconded by Mayer. All in favor. <br /> <br />RESOLUTION No. 47, SERIES 1999 - A RESOLUTION APPROVING A <br />SPECIAL REVIEW USE FOR THE UNITED METHODIST CHURCH FOR <br />EXPANSION OF AN EXISTING CHURCH IN A RESIDENTIAL ZONING <br />DISTRICT, 741 JEFFERSON STREET <br /> <br />Sisk called for staff presentation. <br /> <br />Paul Wood, Planning Director, explained that churches, schools, private clubs and <br />other similar institutional uses are allowed in most residential zoning districts through <br />special review use approval. The Louisville United Methodist Church, located at 741 <br />Jefferson Avenue is requesting approval of a special review use to allow for a two- <br />story expansion on the west side of the existing church. The church received Special <br />Review Use authorization to allow for the expanded use by City Council Resolution <br />No. 38, Series 1997 on 19 August 1997. However, the church did not commence <br />construction of the addition by the time the Special Review Use approval expired. Per <br />City code, such approvals expire within six months if no substantial construction has <br />taken place. Variances twice approved by the Louisville Board Of Adjustment have <br />also expired for the same reason. A variance application was heard and authorized by <br />the Board of Adjustment on 18 August. The church has verbally indicated to Staff, <br />the Board of Adjustment, and the Planning Commission that they now have the <br />means to commence the expansion upon approval. The church expansion is not <br />eligible for a PUD approval because City code does not allow PUDs in residential <br />zones for properties of less than one acre unless that property is a multifamily <br />development containing more than six dwelling units. <br /> <br />The church also owns the building to the south, which is currently used by Fairview <br />Montessori School. A Special Review Use was approved by City Council for Fairview <br />Montessori School in August 1994. That approval was specific for Fairview Montessori <br />only, and limited the facility to 23 students. Based on City zoning requirements, the <br />entire property, Lots 9 through 12 of Block 9, Jefferson Place, which includes the <br />Fairview Montessori School, is considered as one parcel. This is based upon the fact that <br />the property has been under single ownership for many years. <br /> <br />The church is proposing to expand with a two-story addition attached to the west <br />side of their existing facility.
