COUNCIL COMMUNICATION <br />TO: MAYOR AND CITY COUNCIL <br />FROM: MALCOLM FLEMING, CITY MANAGER <br />DATE: MAY 10, 2011 <br />SUBJECT: UPDATE/DISCUSSION – BOARD OF ADJUSTMENT (BOA) <br />ORIGINATING DEPARTMENT: PLANNING AND BUILDING SAFETY DEPARTMENT <br /> ON BEHALF OF THE BOA <br />INTRODUCTION: <br />The Board of Adjustment (BOA) is a six member quasi-judicial board that hears and decides <br />requests for variances from the City’s zoning ordinance. It also hears and decides floodplain <br />development permits and appeals of administrative zoning and floodplain decisions. <br />BOARD MEMBERS: <br />The current board members are: Erik Jasiak, Chair; Chris Fuller, Vice-chair; Horst Loeblich, <br />James Stuart, Gunnar Malmquist, and Wayne Chancellor. Larry Brassem serves as the <br />associate member. All of the positions on the Board of Adjustment are currently full. <br />2010 SUMMARY: <br />The BOA heard three variance requests in 2010. All of the cases dealt with variances for <br />properties in the Old Town Overlay District.One of the cases requested relief from minimum <br />lot size requirements to permit a division of one lot into two. The other two requests were for <br />relief from the minimum building separation requirements and the minimum roof pitch <br />requirement.
