COUNCIL COMMUNICATION <br />TO: MAYOR AND CITY COUNCIL <br />FROM: MALCOLM FLEMING, CITY MANAGER <br />DATE: MAY 10, 2011 <br />SUBJECT: UPDATE/DISCUSSION – BUILDING CODE BOARD OF APPEALS <br />(BCBOA) <br />ORIGINATING DEPARTMENT: PLANNING AND BUILDING SAFETY DEPARTMENT <br />INTRODUCTION: <br />The Building Code Board of Appeals (BCBOA) is a six member quasi-judicial board that hears <br />and decides disputed building code interpretations made by the Chief Building Official. It also <br />serves as an advisory board to the Chief Building official and the Building Safety Division. <br />BOARD MEMBERS: <br />The current board members are: Robert Van Pelt, Chair; Peter Geise, Vice-chair; David <br />Rounds, Gary Mancuso, Matthew Berry, Bart Wear serves as the associate member. All of the <br />positions on the Board of Adjustment are currently full. <br />2010 SUMMARY: <br />Appeals <br />: The BCBOA did not hear any building code appeals in 2010. The board has not <br />heard an appeal since 2005 and only that single appeal since 2000. The Board, the Chief <br />Building Official and the Building Safety Division do their best to be proactive in code <br />interpretation to insure life safety is not jeopardized yet provide practical solutions to <br />homeowners, building owners and contractors. <br />Advisory <br />: The BCBOA has continued work on green building issues, bylaws, residential fire <br />sprinklers, code amendments and the City of Louisville’s Mobile Home Park Ordinance. <br /> Green Building – Mike Jones, the Chief Building Official, participated on the Sweep <br />stakeholder panel to help produce the attached document, Regional recommendations and <br />Toolkit for Green Building Program in the Denver Metropolitan Area. The Chief Building Official <br />has continued to keep the BCBOA abreast of the developments in the green building issue. <br /> BCBOA Bylaws -The City of Louisville reworked the bylaws with legal counsel and has <br />submitted to the BCBOA for approval. The BCBOA has been working through some <br />amendments to these bylaws. <br /> Residential Fire Sprinklers -The BCBOA continues to search for statistical information <br />and follow the State process for regulating fire sprinkler installation contractors.
