<'---', ~- - - -"";" I ) ORDINANCE NO. 742 AN ORDINANCE REQUIRING A SPECIAL EVENTS PERMIT FOR LIVE MUSICAL PERFORMANCES IN RESIDEN'I'IAL AREAS. \\THEREAS, the City Council has determined that a need exists to allow for the control of live musical performances within residential areas of the City; and, WHEREAS, it has been determined that an immediate need exists for such controls and therefor this Ordinance should be considered as an emergency ordinance. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LOUISVILLE, COLORADO: Section 1. The following Chapter 9.40 is hereby added to the Louisville Municipal Code: ~9.40.010 Definitions For purposes of this Chapter, the following definitions shall apply: A. "Live Musical Performance" means a shovv, party or gathering where a musical group playing one or more amplified instruments perform, specifically excluding activities at a church which are part of a religious ceremony. B. "Musical Group" means a group with more than one musician giving a live musical performance. ~9.40.020 Permit Required (A) It shall be unlawful for any person to allow or permit a musical group to perform upon property he owns or occupies in an area zoned as Residential Rural, Residential Estate, Residential Low Density, Residential Medium Density or Residential High Density as defined and designated by Title 17 of this Code unless the owner or occupant of said property has previously obtained a permit for a live musical performance from City Council as set forth in this Chapter. (B) It shall be unlawful for any person to perform as a part of a musical group upon any property in an area zoned as Residential Rural, Residential Estate, Residential Low Density, Residential Medium Density, or Residential High Density as defined and designated
