<br /> ...., "'- <br /> by Title 17 of this Code unless the owner or occupant of said <br /> property has previously obtained a permit for a live musical <br /> performance from City Council as set forth in this Chapter. <br /> (C) The provisions and restrictions of this section shall <br /> not apply to any private club or business establishment which is <br /> duly licensed by the City as of October 1, 1981, and which is <br /> located in any residentially zoned area as defined in Title 17 of <br /> this Code. <br /> ~9.40.030 Application for Permit <br /> An application for a permit for a live musical performance <br /> by a group in a Residential Area may be filed by either the owner or <br /> occupant of the proposed location of the proposed performance and <br /> shall be on a form provided by the City Clerk. The application shall <br /> include: <br /> A. A complete description and diagram of the structure <br /> or property where the proposed performance is to occur, including <br /> dimensions, location of entrances and exits, parking facilities for <br /> guests and restroom facilities; <br /> B. A time schedule for the proposed performance including <br /> date and hours of performance; <br /> C. Number of members in the proposed group and instruments <br /> which will be played; <br /> D. Detailed description of any sound amplification systems <br /> to be used during the performance; <br /> E. Description of means of crowd control; <br /> F. Designation of people responsible for organizing and <br /> putting on performance; and, <br /> G. Estimate of number of people who will attend performance. <br /> ~9.40.040 Public Hearing - Approval or Denial <br /> A. Within 30 days of the filing of an application, the <br /> City Council shall set a public hearing to consider the application. <br /> All owners of property within 200 feet of the site for the proposed <br /> performance shall be notified of the public hearing by first class <br /> ma i L <br /> B. At the conclusion of the public hearing, the City <br /> Council shall either approve or deny the application. No application <br /> -2- <br />
