<br /> shall be approved unless the City Council finds that adequate <br /> provisions have been made for: <br /> 1. Crowd control, including control of ingress and egress <br /> to the performance; <br /> 2. Noise control; <br /> 3. Adequate restroom facilities are to be furnished; <br /> 4. Adequate room is available for the expected or <br /> planned crowd; <br /> 5. Adequate parking is available; and, <br /> 6. Valid and substantial objections of neighboring <br /> property owners. <br /> C. Each permit shall be issued for a specific date, <br /> time and location for a performance. <br /> 9.40.050 Application Fee <br /> An application fee of $20.00 shall be due and payable upon <br /> the filing of an application with the City Clerk. <br /> ~9.40.060 Notice by Publication <br /> Notice of any public hearing held pursuant to this chapter <br /> shall be given by publication at least once in a newspaper of <br /> general circulation within the City. Said notice shall be published <br /> at least ten days prior to such hearing and shall indicate the time, <br /> date and place of the hearing. The notice shall also give the <br /> proposed date, time and location of the proposed musical performance. <br /> Section 2. Section 9.34.010 of the Louisville Municipal <br /> Code is hereby repealed. <br /> Section 3. The following section is hereby added to <br /> Title 9, Chapter 9.34 of the Louisville Municipal Code: <br /> ~9.34.010 <br /> It shall be unlawful for any person to disturb or tend <br /> to disturb the peace and quiet of others by violent, tumultuous, <br /> offensive or obstreperous conduct or loud or unusual noises. <br /> A. The following acts are declared to be loud, disturbing <br /> or unnecessary noises in violation of this section, but shall not <br /> be deemed to be exclusive or limiting: <br /> 1.
