ORDINANCE NO. ___ <br />SERIES 2011 <br />AN ORDINANCE AMENDING THE LOUISVILLE MUNICIPAL CODE TO SET FORTH <br />THAT CERTAIN FEES, RATES AND CHARGES WILL BE ESTABLISHED BY <br />RESOLUTION OF THE CITY COUNCIL <br />WHEREAS, the City Council previously adopted certain fees, rates and charges by <br />ordinance; and <br />WHEREAS, the City Council desires to amend the Louisville Municipal Code to provide <br />that certain fees, rates and charges shall be as set forth by resolution of the City Council;. <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br />Section 1. Section 1.24.010 of the Louisville Municipal Code is hereby amended to read as <br />follows (words to be deleted are shown in strikeout; words to be added are underlined): <br />Sec. 1.24.010. Credit on fine or for time served. <br />Any person imprisoned for the nonpayment of a fine shall be credited for <br />time served at the rate of $50.00 per 24-hour day, exclusive of boardas established <br />by resolution of the city council. <br />Section 2.Section 3.18.110of the Louisville Municipal Code is hereby amended to remove <br />Appendix A, the Impact Fee Schedule, and set such Impact Fee Schedule by resolution of the City <br />Council. <br />Comment [MSOffice1]: <br />LKD Comment: The <br />state impact fee statute says impacts fees shall be <br />imposed according to a fee that is legislatively <br />Section 2. Section 5.04.070 of the Louisville Municipal Code is hereby amended to read as <br />adopted. Therefore, I recommend an ordinance be <br />used to revise impact fees and that this section not be <br />follows (words to be deleted are shown in strikeout; words to be added are underlined): <br />amended to allow for impact fees to be set by <br />resolution. <br />Sec. 5.04.070.
