City Council <br /> Meeting Minutes <br /> March 15, 2011 <br /> Page 4 of 12 <br /> ORDINANCE No. 1590, SERIES 2011 AN ORDINANCE AMENDING TITLE 5 OF <br /> THE LOUISVILLE MUNICIPAL CODE TO ADOPT REGULATIONS REGARDING <br /> BUSINESS LICENSING AND OPERATIONAL REQUIREMENTS FOR MEDICAL <br /> MARIJUANA BUSINESSES 2nd Reading Public Hearing <br /> ORDINANCE No. 1591, SERIES 2011 AN ORDINANCE AMENDING TITLE 17 OF <br /> THE LOUISVILLE MUNICIPAL CODE TO ADOPT REGULATIONS REGARDING <br /> MEDICAL MARIJUANA BUSINESSES 2" Reading Public Hearing <br /> Mayor Sisk requested a City Attorney introduction. <br /> City Attorney Light introduced Ordinances No.1590 and 1591, Series 2011. <br /> Mayor Sisk opened the public hearing requested a Staff presentation on both <br /> ordinances. <br /> Planning Director Russ reviewed the second reading amendments to Ordinance 1590, <br /> Series 2011. Revisions were made in Section 4, Section 5.10.070.A and Section <br /> 17.16.235.B1. He gave a brief history of Amendment 20 to the Colorado Constitution <br /> approved by Colorado voters in 2000 and House Bill (HB) 10 -1284, concerning the <br /> regulation of medical marijuana, which provides guidance on local governments' ability <br /> to regulate such businesses. <br /> Ordinance 1590, Series 2011 amends Title 5 of the LMC to: (1) establish a <br /> comprehensive licensing ordinance for all medical marijuana centers and infused <br /> products manufacturers; (2) set location requirements for medical marijuana businesses <br /> and requirements governing the operation of these businesses; and (3) address the <br /> cultivation of marijuana by patients and primary caregivers who serve no more than five <br /> patients (unless the primary caregiver has been authorized by the state health agency <br /> to serve additional patients) and do not constitute a medical marijuana center. <br /> Types of Licenses and Licensing Procedures The proposed provisions would allow <br /> two types of licenses: <br /> 1. A medical marijuana center (MMC) license shall be issued only to a person <br /> selling medical marijuana pursuant to the terms and conditions of the City's <br /> ordinance and C.R.S. 12- 43.3 -402 to registered patients or primary caregivers <br /> as defined in Article XVIII, Section 14 of the Colorado Constitution, but is not a <br /> primary caregiver. <br /> 2. A medical marijuana- infused products manufacturing license may be issued to <br /> a person who manufactures medical marijuana- infused products, pursuant to the <br /> terms and conditions of the City's ordinance and C.R.S. 12- 43.3 -404. <br /> The ordinance designates the Authority as the licensing authority for the City.
