The Authority is given the power to <br /> adopt rules of procedure related to these activities. <br /> Ordinance 1591, Series 2011 amends Title 17 of the LMC to define medical marijuana <br /> businesses that may receive licenses consistent with definitions in HB 10 -1284 and to <br /> specify the permitted and non permitted uses associated with medical marijuana <br /> businesses. While HB 10 -1284 recognizes at a state level a license for cultivation <br /> activities on identified optional premises, the City ordinance expressly prohibits <br /> cultivation within the City. <br /> Location, Proximity, and Size -In addition to the permitted uses and zoning designations <br /> identified in Title 17, staff recommended the following criteria be included as part of the <br /> licensing regulations: <br /> 1. Allowed only in the Commercial Business (C -B) zone district; <br /> 2. A 1,320' separation requirement from schools, public playgrounds, outdoor <br /> pools, outdoor education facilities serving children, alcohol or drug treatment <br /> facilities, and residential childcare facilities; <br /> 3. A maximum allowance of no more than one medical marijuana business within <br /> a 1,320' radius; <br /> 4. A maximum leasable square feet allowance of 1,800 SF; <br /> 5. Not allowed on City property; and <br /> 6. Not allowed to operate as an outdoor vendor. <br /> Mayor Sisk requested public comments. There were no comments. <br /> COUNCIL COMMENTS <br /> Councilor Muckle requested restrictions on signage. He felt if there were any <br /> references to marijuana in the signage it should include "medical" marijuana and no <br /> other phrases. <br /> Mayor Pro Tem Marsella voiced her appreciation to Planning Director Russ, Deputy City <br /> Manager Balser and City Attorney Light for their work on both ordinances. <br /> Mayor Sisk suggested that anyone who has any interest in a Medical Marijuana Center <br /> be subject to the application process. He also voiced his appreciation to the staff for <br /> their work. <br /> Deputy City Manager Balser noted the Planning Commission's two dissenting votes felt <br /> Medical Marijuana Centers should be banned in the City. <br /> Mayor Sisk closed the public hearing. <br />
